The homes to be constructed is funded by the United States Department of Housing and Urban Development, Office of Indian Programs. The work to be performed is subject to Section 7 (b) of the Indian Self Determination and Education Assistance Act (25USC 405 e (b). Section 7 requires that any contract or subcontract will give Indian preference to any company owned by a member of a federally-recognized Indian Tribe. All bids must be accompanied by a bid guarantee which shall not be less than five percent (5%) of the amount of the bid. This may be a certified check, bank draft, U.S. Government Bonds at par value, or a bid bond secured by a surety company acceptable to the U.S. Government and authorized to do business in the state where the work is to be performed.
