All Bids must be accompanied by an amount of not less than ten percent (10%) of the aggregate of the bid proposed in the form of (a) lawful monies of the United States; (b) a cashier's check, certified check, bank money order or bank draft, in any case drawn and issued by a national Banking association located in the State of Montana; (c) a Bid bond or bonds executive by a surety corporation authorized to do business in the State of Montana. These securities will be forfeited to the Butte-Silver Bow City-County Government as liquidated damages if the requirements in the way of contract are not entered into within fifteen (15) days after the date of award by the Council of Commissioners. The successful Bidder shall comply with all applicable Federal Regulations and Requirements which include but are not limited to Section 3 Clause, Equal Opportunity Clause, Executive Order 11246 and 11624, Federal Labor Standards and Civil Rights Act. Accordingly, the CityCounty of Butte-Silver Bow reserves the right to negotiate an agreement based upon fair and reasonable compensation for the scope of work and services proposed, as well as the right to reject any and all bids and to accept the bid deemed to represent the best interests of the CityCounty of Butte-Silver Bow. Each bidder must inform him/her-self of all conditions relating to the construction of the project and the employment of labor thereon. 2. Failure to do so will not relieve a successful bidder of his obligation to furnish all material and labor necessary to carry out the provision of his contract. EMPLOYMENT AND WAGE RATE REQUIREMENTS The successful Bidder shall give preference to the employment of bona fide Montana residents in the performance of the work and shall pay the higher of the Federal or State of Montana standard prevailing rate of wages for Heavy Construction, including fringe benefits for health and welfare and pension contribution and travel allowance provisions in effect and applicable to Butte-Silver Bow. Prevailing wage rates may be obtained from the Labor Standards Division, Capitol Station, Helena, Montana 59602, telephone number 406-444-5600 Contractor shall provide Butte-Silver Bow with a copy of their certified payroll, for Contractor and all Subcontractors, with each request for payment. LENGTH OF CONTRACT (notice to proceed) This contract is scheduled to be awarded on March 27th, 2024 with notice to proceed after May 1st, 2024. Substantial Completion of Work is to be completed by September 30th, 2024 from the issuance of the notice to proceed. Final Completion is to be reached within FIFTEEN (15) fays of Substantial Completion. Final payment will not be made until Final Completion is reached. DESRCIPTION OF WORK Work to be performed under this contract includes: Furnishing all labor, materials, and equipment for chip sealing portions of the following streets in Butte, Montana: Lyndale Ln E Side, Aspen Ln, Grand View Dr, Lyndale Ln W Side, Wagon St, Low St, Tower Rd, High View St, Mountain View Rd, Waldron Dr, Trotter Dr, Saddle Ln, Janney Rd. The bids shall include all mobilization, traffic control, 25 pounds of chips per square yard of chipping and placing tabs on striping including angle parking, covering of all manholes and utility box lids, spreading oil and chips by hand in tight areas as needed, sweeping the chipped street, and disposing of chips. For the purpose of bidding, THE CONTRACTOR shall complete the bid sheets for each individual item by providing a lump sum amount for each particular item. The total project amount will be determined by the sum of all these individual items. BUTTE-SILVER BOW will make no partial payment for items not complete.
