Power washing and sealing of all exterior block at 3 schools is required: 1.Lincoln Middle School Building 2.Lincoln High School Building 3.Bridgeport High School Building Each bidder shall be capable to furnish all labor, material and equipment necessary to execute and fulfill the specified work within this document in an exemplary and professional manner, and as specified. A Bid Bond is not required for this project. A. No Performance & Material Bond is required for projects of $25,000 or less. B. For projects exceeding $25,000, the bidder to whom the contract is awarded shall pay for, execute, and deliver to the Owner within ten (10) business days after award of the contract by the Owner a 100% corporate surety Performance and Material Payment Bond on AIA Document A311 (or equivalent form), to be executed by a solvent Bonding company listed in the most current Federal Register, Circular 570, and is authorized to do business in West Virginia. The labor and material Bond shall be in the sum of 100% of the company contract. C. An irrevocable Letter of Credit is not acceptable as a Performance Bond. Liquidity Damages: Bids may not be withdrawn for a period of thirty (30) days following the date for receipt of bids without forfeiture of bid security as liquidated damages, not as a penalty. It is understood and agreed by and between the parties hereto that the payment by the contractor to the Owner of the sum of $150.00 per day for every calendar day the contractor fails to substantially complete the project. Said liquidated damages shall be fair and reasonable compensation to the Owner for the damages sustained by the Owner by reason of failure to complete said contract. The payment of such sum by the contractor will not in any way constitute the infliction upon the contractor of a penalty by the Owner. It is further understood and agreed by the parties hereto that the contractor shall allow the Owner, as liquidated damages and not as a penalty, that the sum of the liquidated damages as determined by the Owner shall be deleted from the final payment by the Owner. Owner Rights: The Owner reserves the right to conduct such investigation as necessary to determine the responsibility of a bidder, to waive all informalities in the bidding process to the extent permitted by law, to reject any or all bids, and to make selections from the bids that are solely in the best interest of the Owner. A. The Owner shall have the right to reject any or all bids and to reject a bid not accompanied by the required bid security or by other data required by the bidding documents or to reject a bid which is in any way incomplete or irregular. B. The Owner shall have the right to reject a bid based on a bidder's past work practices (with the Owner and/or other firm/government agency). In addition, any judgments or complaints against a bidder shall be cause to reject a bid. C. The Owner shall be the sole determiner as to bid acceptance or rejection.
