As of March 31, 2025, this project is in the design phase. Construction bidding will likely take place in the late summer. Phase I - Design Consists of a two preliminary conceptual designs and estimated costing for each design. The first design is the design of just an additional storage pond to offset the existing pond, landscaping would be as is at existing pond. The second design is the design of secondary storage pond that will also be an urban fishery/park, like the Cove at Herriman Springs. The purpose of the preliminary designs are for presenting to City Staff, planning commission and City Council. The selected firm will be required to provide conceptual designs and an estimated cost to complete each project. The selected firm may be required to present the preliminary design and cost estimate to the planning commission and City Council. In order to complete the preliminary design and present to Council the firm will be required to meet with city staff (formal meeting, phone calls are not counted as a meeting) 6 times (City Council is counted as one of the 6). Liquidity Damages: Project must be completed and delivered to the City according to the dates agreed upon based upon negotiations. Timing is of the essence for this project. Consultant agrees that the City will suffer damages if required documents are not received as agreed upon. The Consultant will compensate the City in the amount of one hundred dollars and no cents ($100.00) for each day or part thereof that expires after dates indicated, for damages, penalties, extra fees or losses that the City may incur due to a late delivery of the required documents. The City shall be entitled to deduct and retain liquidated damages out of any money which may be due or become due to the Consultant. To the extent that the liquidated damages exceed any amounts that would otherwise be due the Consultant, the Consultant shall be liable for such amounts and shall return such excess to the City. Owner Rights: . The city reserves the right to: 1) reject any or all proposals, or to make no award; 2) require modifications to initial proposals; 3) negotiate or 4) make partial or multiple awards. The city further reserves the right to excuse technical defects in a proposal when, in the sole discretion of the City, such excuse is beneficial to the city.
