The Town Board reserves the right to reject any or all bids. The bidder, in submitting his bid/proposal, agrees to enter into said contract with the Town of Greenburgh, if he is the successful bidder(s), for the service in accordance with his bid/proposal. Please be advised the Town of Greenburgh reserves the right to makes multiple (split awards) if deemed necessary to obtain the needed service, in order to satisfy contractual requirements. Moreover, the Town of Greenburgh reserves the right to award bids on an item by item basis if deemed necessary, and to reject any and all bids, if deemed to be in the best interest of the Town. The bidder must submit unit prices on the forms supplied, in the space or spaces provided for same, both in figures and in words. Whenever a unit price in figures differs from the unit price as stated in words, the price written in words will be considered to be the bid. The bidder must note that the material and/or equipment include FOB delivery to Anthony F. Veteran Park, 11 Olympic Lane, Ardsley, New York 10502. All bids or proposals must be signed by the bidder. The bidder is not to take specifications and bidding pages apart, but must return same complete. The Town of Greenburgh is exempt from payment of all Federal and New York State taxes. Tax exemption certificates will be issued to the successful bidder. The bidder is to familiarize themselves with all terms and conditions in accordance with the specifications, and any resultant contract(s), resulting from this solicitation. Any and all requests for clarification will be honored by the Town of Greenburgh. If any subsequent disputes arise, either before or after award, all Town stakeholders, including legal counsel, will convene to discuss and resolve the matter with the bidder(s) in question. In the Town's discretion, no bid will be accepted from, or contract awarded to, a bidder in default upon any obligations to the Town of Greenburgh. The Town Board reserves the exclusive right to select the bid(s), proposal(s), the acceptance of which, both satisfies program needs, and is consistent with NYS specific guidance for Invitation For Bids (IFBs). That guidance states for commodities, award shall be made on the basis of lowest price among responsive and responsible offers. A split award may be made, since the Town has specified in the solicitation, that they have the right to award bids on an item by item basis. Finally, the Town reserves the right to reject any and all bids which are deemed to be incomplete, altered, conditional, or obscure. Upon acceptance by the Town Board, this bid, with all attachments, terms and conditions, and specifications, shall constitute a contract between the Town and the successful awardee(s). The bid notice, information for bidders, and specifications, all annexed hereto, are part of this contract.
