The District will initiate negotiations with the highest ranked firm in order to agree to fair and reasonable fees related to pre-construction design phase services, overhead and profit, and general conditions. In making this determination, the District shall take into account the estimated value, the scope, the complexity and the nature of the pre-construction design phase and construction services to be rendered. Each job will be evaluated for liquidated damages and will be addressed prior to issuing a purchase order. Contractor shall be liable for and shall pay District the sum of 1,000 per day as liquidated damages, and not as a penalty, for each calendar day of delay after the date specified in the Solicitation July 1, 2026 or any extension thereof granted by District for completion of work until the work is complete. Contractor shall pay liquidated damages to District without limiting District right to terminate the Contract for default as provided elsewhere herein. District shall grant an extension for completion of work if the work is delayed for an unforeseeable cause beyond the control and without fault of Contractor and Contractor notifies District in writing immediately in writing of the cause of the delay and provides sufficient information for District to determine whether an extension is justified. The District shall determine whether an extension is justified in its sole discretion. The successful CMAR contractor shall be required to furnish a non-revocable security binding the contractor to provide faithful performance of the contract in the amount of 100% of the Guaranteed Maximum Price (GMP). Bonds shall be payable to the Agua Fria Union High School District #216 Performance security shall be in the form of an annual or one-time bid bond issued by a security company authorized to do business in the State and rated "B+" or higher in Best's Guide, certified check, or cashier's check. The conditions and provisions of the Performance Bond regarding the surety's obligations shall follow the form required under ARS 34-222(G) or ARS 34-610(G), as applicable. Bonds must be issued by a surety company authorized to do business in Arizona, or in a manner satisfactory to the District. This security must be in the possession of the District within the time specified or ten (10) days after award of GMP. If the Contractor fails to execute the security document as required, the Contractor may be found in default and the Contract terminated by the District. In case of default, the District reserves all legal rights to rectify matter. The successful CMAR Contractor shall be required to furnish a Payment Bond equal to 100% of the GMP. The Bond shall be submitted to the District within ten (10) days of the award of the GMP. The conditions and provisions of the payment bond regarding the surety's obligations shall follow the form required under ARS 34-222(F) or ARS 34-610(F). The surety will be in the form of a bond, cashier's check, certified check, or money order. Personal and company checks are not acceptable unless they are certified. Bonds must be executed by a surety company authorized to do business in Arizona or otherwise secured in a manner satisfactory to the District. The Agua Fria Union High School District reserves the right to reject proposed subcontractors. All subcontractors must be approved by the school district prior to start of work.
