This RPQ is issued under the terms and conditions of the Miscellaneous Construction Contracts (MCC) Program MCC 7360 Plan. Project Name: Rehabilitation of Sanitary Sewer by the CURED-IN-PLACE PIPE -CIPP- LINING METHOD - Phase B Project Location: Various County Locations License Requirements: Primary: General Building Contractor; General Engineering; Pipelines Engineering Contractor; Underground Utility / Excavation. (Contractor must obtain and submit all permits prior to performing any work). 1.00 SCOPE The Project consists of furnishing all labor, materials, and equipment necessary for rehabilitating defects in 8 through 24-inch diameter gravity sanitary sewer pipes and 6-inch or 4-inch diameter service laterals by the cured-in-place pipelining method, under different work orders at various locations anywhere within the limits of Miami-Dade County, Florida, as ordered by MD-WASD during contract period. This work includes supplementary cleaning of the affected existing gravity sanitary sewers, isolating the reach of sewer to be repaired, inspecting it with closed circuit television (CCTV), then installing a cured-in-place pipe liner, and reinspecting the repaired reach with CCTV. Repairs in industrial areas will utilize an epoxy vinyl ester resin system and repairs in nonindustrial areas a polyester resin system or an epoxy vinyl ester resin system. The work in the sewer shall be accomplished through the manholes, without disturbing the street surface or adjacent property or any utility. Work also includes bypass pumping of sewage or plugging and monitoring, if needed, and other appurtenant and miscellaneous related items and work for a completed Project. The terms "work," "lining," "construction," "repair" and "cleaning" shall each be construed to denote any and all activities under this contract, regardless of its nature. This is a non-exclusive contract. Other contracts for the rehabilitation of sanitary sewers by the cured-in-place pipelining method may be advertised, bid and under construction concurrent with this Project. It is the intent of the Department to attempt, where it is practical and convenient for the Department to do so and as a convenience to the Contractor, to package groups of Work Orders by pump station drainage area and industrial and non-industrial lots. However, the Department reserves the right to issue independent repair Work Orders to expedite the Project. Additionally, while the Contractor is mobilized, the Department reserves the right to add additional, smaller, or larger Work Orders to the overall assignment. The Contractor must certify that he has a minimum of three (3) installation crews and equipment to complete the work in a timely fashion. The Contractor is also alerted that various "Standards" are used herein for reference and criteria and that he should obtain copies for his general use and protection. Abbreviated titles are used throughout these Specifications and although most of them are widely known, their complete titles are given below to avoid any misunderstanding. AASHTO American Association of State Highway and Transportation Officials ANSI American National Standards Institute ASTM American Society for Testing and Materials AWWA American Water Works Association FDOT Florida Department of Transportation MDWASD Miami-Dade Water and Sewer Department The above list shall not be considered complete, as there are other "Standards" used, however, in most cases complete titles have been given. Wherever "Standards" are indicated herein for reference, the referenced portion shall have the same force and effect as if it were included herein in its entirety, latest edition, or revision, if date of publication is not shown. 1.01 Minimum Requirements of the Bidder A. License Requirements 1. At the time of Bid and pursuant to the requirements of Section 10-3 of the Code of Miami-Dade County, Florida and these Solicitation and Contract Documents, the Bidder must hold a valid, current, and active: a. Certificate of Competency from the County''s Construction Trades Qualifying Board as a General Engineering Contractor or as a Pipeline Engineering Contractor. The Pipeline Engineering Contractor shall subcontract with a qualified contractor any work which is incidental to the pipeline specialty but is specified in the aforementioned Code as being the work of other than that of the Engineering Specialty for which certified. or b. Certification, as a General Contractor or as an Underground Utility and Excavation Contractor, provided by the State of Florida Construction Industry Licensing Boa he provisions of Section 489.115, Florida Statutes. B. Additional Qualifications of the Contractor 1. The successful bidder shall submit a schedule of their proposed work, as bid, including information on the experience of the firm, the personnel assigned to the repair work, and especially the experience of the crew leaders who will run the work in the field, as well as information on all equipment and the type of process that will be used for lining. The Contractor must certify that he has a minimum of three (3) installation crews and equipment in order to complete the work in a timely fashion. The contract will not be awarded, and no work shall commence until these submittals have been approved and the successful bidder has received a written Notice to Proceed, respectively. 2. The Department reserves the right to reject individual crew leaders due to either inadequate experience, or unsatisfactory or poor performance on the job (in the Department''s or the Construction Manager''s opinion). Along with his bid, the Contractor must submit proof that his/her firm has been regularly and successfully engaged in the commercial installation of the liner product for a minimum of one (1) year and has successfully performed an aggregate amount of at least 200,000 linear feet of sanitary sewer repairs of pipes 6 through 24 inches in diameter (or larger) in subaqueous conditions. C. Experience 1. In addition to the license requirements, Bidders are required to submit at the time of bid the Cure-in-Place Pipe main line experience providing current contact information for each referenced project that will allow the County to verify the referenced project. 2. The prime must meet the requirement of experience to perform the work under this contract. The bidding entity as a firm shall have the required experience. 3. The Prime Contractor and his proposed lining system, including verification that he is authorized by the manufacturer as an authorized installer, all main line lining work shall be performed by the contractor's own forces. 4. Subcontracting of the CIPP main line lining is not permissible. Contrary to any other provisions within the Contract Documents related to subcontracting, due to the nature of this project. The Prime Contractor shall be required to self-perform all CIPP main line lining. 5. The Contractor must submit proof that his/her firm has the ability to interface with MD-WASD and familiarity with County guidelines. The ability will be based upon the evaluation of the Company by "Past performance Evaluations" (PPE) from Miami-Dade County approach including experience in Rehabilitation of Sanitary Sewer by the Cured in Place Lining Method (CIPP) projects under WASD's Contracts. 6. The successful bidder shall submit a schedule of their proposed work, as bid, including information on the experience of the firm, the personnel assigned to the repair work, and especially the experience of the crew leaders who will actually run the work in the field, as well as information on all equipment and the type of process that will be used for lining. The Contractor must certify that he has a minimum of three (3) installation crews and equipment in order to complete the work in a timely fashion. The Department reserves the right to reject individual crew leaders due to either inadequate experience, or unsatisfactory or poor performance on the job (in the Department''s or the Engineer''s opinion). Along with his bid, the Contractor must submit proof that his/her firm has been regularly and successfully engaged in the commercial installation of the liner product for a minimum of one(1) year and has successfully performed an aggregate amount of at least 200,000 linear feet of sanitary sewer repairs of pipes 6 through 24 inches in diameter (or larger) in subaqueous conditions. 8. The requirement for 200,000 LF installation experience shall be on water cured application only. 9. Bidders are required to submit proof that his/her firm has three (3) separate independent crews available for the duration of the Contract. Bidders shall provide crew information with their Bid submittal. The three (3) independent shall always be available unless otherwise approved by the Department. 10. The Bidder must have a minimum of five (5) years of experience, under its current business name (which can include the experience of key supervisory employees that would man the project), in the construction of roadway / horizontal projects of similar scope and scale involving public right-of-way construction / installation / repair / replacement of main water distribution systems and/or main sanitary sewer collection systems including gravity sewer service laterals with assemblies, and maintenance of vehicular traffic, supported by references for three (3) projects completed within the past ten (10) years. Submitted reference Projects must demonstrate that the Bidder served as the Prime Contractor for the referenced Projects provided. 11. The Bidder must demonstrate that it has full-time personnel with the necessary experience to perform the Project''s Scope of Work. This experience shall include work in successfully completed projects performed by the identified personnel whose bulk of work performed in the public right-of-way is similar in detail to the Project''s Scope of Work described in these Solicitation Documents. Demonstrate the experience requirement by: a. Providing a detailed description of at least three (3) projects similar in detail to the Project''s Scope of Work described in these Solicitation Documents and in which the Bidder''s identified personnel is currently engaged or has completed within the past ten (10) years. List and describe the projects and state whether the work was performed for the County, other government clients, or private entities. The description must identify for each project: 1) The identified personnel and their assigned role and responsibilities for the listed project 2) The client's name and address including a contact person and phone number for reference. 3) Description of work 4) Total dollar value of the contract 5) Contract duration 6) Statement or notation of whether Bidder''s referenced personnel is/was employed by the prime contractor or subcontractor, and 7) For completed projects, provide letters of certification of final acceptance or similar project closure documentation issued by the client and available Contractor''s performance evaluations. 12. The County reserves the right to request additional information and/or contact listed persons pertaining to the bidder's experience. Design Drawing Included: YES Shop Drawing Included: YES Specifications Included: YES Anticipated Start Date: 6/3/2024 Calendar Days for Project Completion: 365 EMPLOY MIAMI-DADE PROGRAM In accordance with Section 5.02 of the Miami-Dade County Home Rule Amendment and Charter, Section 2-8.1 of the Code of Miami-Dade County, and Administrative Order No. 3-63, all contractors and subcontractors of any tier on (i) construction contracts valued in excess of one million dollars ($1,000,000) for the construction, demolition, alteration and/or repair of public buildings, or public works; or (ii) contracts or leases valued in excess of one million dollars ($1,000,000) for privately funded construction, demolition, alteration or repair of buildings, or improvements on County-owned land. The awarded Contractor is hereby notified that the County will consider whether the Contractor made its best reasonable efforts to promote Employ MiamiDade on this contract, as defined in A.O. 3-63, as part of the County's evaluation and responsibility review of the Contractor for new County contract RESIDENTS FIRST TRAINING AND EMPLOYMENT PROGRAM In accordance with Section 2-11.17 of the Code of Miami-Dade County and Implementing Order No. 3-61, all contractors and subcontractors of any tier on (i) construction contracts valued in excess of $1 million for the construction, demolition, alteration and/or repair of public buildings, or public works; or (ii) contracts or leases valued in excess of $1 million for privately funded construction, demolition, alteration or repair of buildings, or improvements on County-owned land shall comply with the following: (i) prior to working on the project, all persons employed by the contractor or subcontractor on the project to perform construction have completed the OSHA 10-hour safety training course, and (ii) the contractor will make its best reasonable efforts to have 51% of all construction labor hours performed by Miami-Dade County residents. Pursuant to Section 2-8.10 of the Code of Miami-Dade County, this Contract is subject to a user access fee under the County's User Access Program (UAP) in the amount of two percent (2%). All construction services provided under this contract are subject to the 2% UAP. This fee applies to all Contract usage whether by County Departments or by any other governmental, quasigovernmental or not-for-profit entity. From every payment made to the Contractor under this contract (including the payment of retainage), the County will deduct the two percent (2%) UAP fee provided in the ordinance and the Contractor will accept such reduced amount as full compensation for any and all deliverables under the contract. The County shall retain the 2% UAP for use by the County to help defray the cost of its procurement program. Contractor participation in this pay request reduction portion of the UAP is mandatory. Provided, however, UAP shall not be applicable for total contract values, inclusive of contingency and allowance accounts, of less than five hundred thousand dollars ($500,000.00). Bid submission must be electronic, through the eBuilder Bid Portal, with a hard copy sent to WASD postmarked within one (1) business day of the bid submittal date, mailed to WASD [3071 SW 38th Avenue, Suite 107, Miami, FL 33146] The original Bid Security (in the form of a bid bond or cashier's check) MUST be delivered to WASD, at the address above, BEFORE the bids are opened. Failure to deliver the original will result in the bid submission being rejected as non-responsive. Invited bidders should have received an Invitation to Bid with an Invitation Key linked to the Invitee's email address. Upon request, an invitation can be sent to multiple email addresses within the same company. However, if multiple bids are submitted by the same company, ALL submitted bids will be rejected. The bid set includes electronic bid instructions. Training on electronic bid submission is available every Monday from 9 - 10 and every Wednesday from 1 - 2. The RFI cut-off date is five (5) business days prior to the bid due date Liquidated Damages - $1,000.00 per day. The contractor must include in their bid package the following documents: 1. Appendix 5A, 2. Quotation Forms Pages, 3. Addendums, 4. Bid Bond - Note: A Bid Bond will be required only if the bid meets or exceeds $200K. In addition, a Performance and Payment Bond with additional insurance will be required once bid is Awarded and bid meets or exceeds $200K. 5. COA (Certificate of Assurance) form. Regarding CWP applicability, a CWP (Community Workforce Goal) is not applicable on this project. Also, Residents First and Employ Miami-Dade programs are applicable to this project. Fla. HB-3 Language Nothing in this RFP shall in any way be utilized to request documentation relating to or authorizing consideration of a proposer''s social, political, or ideological interests when determining if the proposer is a responsible vendor or give a preference to a proposer based on the proposer''s social, political, or ideological interests. o Contractor shall indemnify and hold harmless the County and its officers, employees, agents and instrumentalities from any and all liability, losses or damages, including attorneys' fees and costs of defense, which the County or its officers, employees, agents or instrumentalities may incur as a result of claims, demands, suits, causes of actions or proceedings of any kind or nature arising out of, relating to or resulting from the performance of this Agreement by the Contractor or its employees, agents, servants, partners principals or subcontractors. Contractor shall pay all claims and losses in connection therewith and shall investigate and defend all claims, suits or actions of any kind or nature in the name of the County, where applicable, including appellate proceedings, and shall pay all costs, judgments, and attorney's fees which may issue thereon. Contractor expressly understands and agrees that any insurance protection required by this Agreement or otherwise provided by the Contractor shall in no way limit the responsibility to indemnify, keep and save harmless and defend the County or its officers, employees, agents and instrumentalities as herein provided. The Contractor shall furnish to Water and Sewer, 3071 SW 38 Avenue, Douglas Building, Miami Fl 33146, Certificate(s) of Insurance which indicate that insurance coverage has been obtained which meets the requirements as outlined below: A. Worker's Compensation Insurance for all employees of the Contractor as required by Florida Statute 440. a. If applicable should include coverage required under the U.S. Longshoremen and Harbor Workers' Act (USL&H) and/or Jones Act for any activities on or about navigable water. B. Commercial General Liability in an amount not less than $1,000,000 per occurrence, and $2,000,000 in the aggregate. Miami-Dade County must be shown as an additional insured with respect to this coverage. C. Automobile Liability Insurance covering all owned, non-owned and hired vehicles used in connection with the work, in an amount not less than $1,000,000 combined single limit per occurrence for bodily injury and property damage. *Under no circumstances are Contractors permitted on the Aviation Department, Aircraft Operating Airside (A.O.A) at Miami International Airport without increasing automobile coverage to $5 million. Only vehicles owned or leased by a company will be authorized. $1 million limit applies at all other airports. o 7360 RPQs are NOT SBE-Con 100% Set-aside solicitation, however the RPQ may be assigned a SBE-Con Trade setaside and goal. The SBE-Con Trade-aside and goal if applicable will be will be stipulated on the RPQ and the Invitation to Bid or in the Project's Solicitation Documents. o All Prime Contractors submitting a bid for RPQ/Project with a Small Business Measures (s) MUST submit the Small Business Development "CERTIFICATE OF ASSURANCE" form properly completed, signed and notarized with their bid document at the time of Bid Submittal. FAILURE TO SUBMIT THE REQUIRED CERTIFICATE OF ASSURANCE FORM AT THE TIME OF BID SUBMISSION SHALL RENDER THE BID NON COMPLIANT TO THE CONTRACT REQUIREMENT AND SECTION 10.33.02 OF THE CODE OF MIAMI-DADE COUNTY. o 7360 RPQs Federally Funded may be subject to the Disadvantaged Business Enterprise (DBE) Program. The DBE goal will be stipulated on the RPQ and the Invitation to Bid or in the Project's Solicitation Documents. o 7040 and 7360 RPQs with an estimated project value in excess of $700,000.00 may be assigned a Small Business Enterprise Goods (SBE-G) or Small Business Services (SBE-S) program goal. The SBE-G or SBE-S goal if applicable will be will be stipulated on the RPQ and the Invitation to Bid or in the Project's Solicitation Documents. o All RPQs with an estimated project value $100,000 or above are subject to Responsible Wage Rates. The wage rate will be stipulated on the RPQ and the Invitation to Bid or in the Project's Solicitation Documents. o All Projects, where price (Proposals/Bids) received are in excess of $200,000 will require the submission of the Payment and Performance Bond as required by State of Florida Statute.
