The project consists of Rehabilitating the existing collection system including replacement of approx. 688 LF of 15" sewer line, 1,635 LF of 18" sewer line, 1,636 LF of Force Main, lift station rehabilitation, and other miscellaneous items of construction. Bond Notes: A Bidder's Bond, Certified or Cashier's Check in an amount not less than (5%) of the total bid shall accompany each quote as a guarantee that, if awarded the contract, the Contractor will promptly enter into contract with the City of Daingerfield. Full (100%) performance and payment bonds are required on all contracts in excess of $25,000.00. The only exception is that if the contract is less than $50,000.00, the Owner may hold all payment until final completion, in lieu of the performance bond. Such bonds must be issued by a corporate surety authorized to do business in the State of Texas. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Texas Department of Rural Affairs and contained in the contract documents, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, age or national origin. Owner Rights: The Owner reserves the right to reject any or all bids and waive any or all irregularities. No bid may be withdrawn until the expiration of 60 days from the date bids are open. Liquidity Damages:. Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with the Contract. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty) Bidder agrees that the Work will be substantially complete within two hundred seventy (270) calendar days after the date when the Contract Times commence to run as provided in Paragraph 4.01 of the General Conditions, and will be completed and ready for final payment in accordance with Paragraph 15.06 of the General Conditions within three hundred (300) calendar days after the date when the Contract Times commence to run.
