Site work and paving for a mixed-use development in Dublin, California. Completed plans call for site work for a road / highway; for paving for a road / highway; sidewalk / parking lot; and sidewalk / parking lot.

PROJECT SCOPE: The Project is more specifically defined in the Contract Documents, but generally includes: furnishing all labor, materials, tools, equipment, transportation, and services necessary to perform the construction and installation of the following: Concrete flatwork including sidewalk, curb and gutter, median curb, median island, and curb ramps, install owner furnished video detection system, replace pedestrian push buttons with Accessible Pedestrian Systems, pavement failure repair, pavement grinding, reconstruction of trail with hot mix asphalt and aggregate base pavement section, crack sealing, paving mat (GlasGrid), hot mix asphalt overlay, removal of pavement marking and striping, and installation of pavement markings and striping, traffic control, and other items not specifically mentioned herein, and doing all appurtenant work in place and ready for use, all as shown in the Specifications, Special Provisions, and other Contract Documents entitled as shown above, now on file in the office of the Public Works Director, to which reference is hereby made for further particulars. COST ESTIMATE: The City's estimated total construction cost for this Project is between $1,600,000 and $1,700,000. The estimate is intended to serve merely as a guideline of the magnitude of work. Neither the bidders nor the contractor shall be entitled to claims because of any inaccuracy in the estimated cost range. BID PREPARATION COST: Bidders are solely responsible for the cost of preparing their Bids. BIDDER QUALIFICATION: General Contractors bidding this project shall have successfully completed the construction or substantial renovation of a minimum of ten (10) "qualifying" facilities for City, County, or State in the State of California, in the last five (5) years, for which the bidding Contractor was the General Contractor for the work. Bidders shall also fulfill the minimum bidder qualification requirements in the Bidder Qualification Statement (Bid Document Forms). Bids from General Contractors not meeting these requirements shall be determined to be non-responsive. CONTRACT TIME & LIQUDATED DAMAGES: The Project is to be completed within a total maximum of Seventy five (75) Working Days after: a) the date specified in the City's Notice to Proceed, or b) 25 calendar days following the date of the Contractor's receipt of the Notice of Award letter, whichever comes first. The City will assess liquidated damages in the amount of $1,000 for each and every calendar day of delay in finishing the work in excess of the contract time. CONTRACT DOCUMENTS: All proposals or bids shall be made upon the proposal form included in the bid documents. They must be sealed and addressed to the City Engineer of the City of Dublin and must be plainly endorsed with the Contractors name, address, phone number, include the title and project number of the Project, and the name of City project contact as identified in the Notice. PLAN HOLDERS LIST: Copies of the plan holders list can be obtained from BPXpress Reprographics by calling (707) 745-3593 or online. Bid packages are available for viewing at online. BONDS AND INSURANCE: Pursuant to California Public Contract Code Section 20171, all bids must include bid security in the amount of ten percent (10%) of the Bid Amount. After award of contract, the successful bidder must provide security for faithful performance, labor and materials, and warranty, as well as proof of insurance, in accordance with the requirements set forth in the Contract Documents. Bonds must be executed by an admitted surety possessing a valid certificate of authority issued by the California Department of Insurance. CONTRACTOR LICENSE(S): Pursuant to California Public Contract Code Section 3300, all bidders must possess a valid class A or a combination of C10, C12, and C31 California contractor's license. Firms bidding as a joint venture must secure a joint venture license prior to award of this contract. Failure to possess the specified license(s) at the time of bidding shall render the bid non-responsive. COMMUNITY WORKFORCE AGREEMENT REQUIREMENTS: Bidders are hereby notified that they must comply with the Community Workforce Agreement for the City of Dublin (see section P-20) OR the Bidder must meet applicable good faith efforts criteria. SECURITIES SUBSTITUTION: Pursuant to California Public Contract Code Section 22300 the successful bidder may, on request and at its expense, substitute securities in lieu of amounts withheld by the City from progress payments to ensure performance under the contract. Such securities will be subject to the terms of the escrow for security deposit agreement contained in the contract documents. The City processing fee for the escrow request is a one-hundred dollar ($100.00) handling charge per billing transaction. DEPARTMENT OF INDUSTRIAL RELATIONS: This project is a public work and subject to California Labor Code Section 1770 et seq., including but not limited to the following: Contractor and subcontractors listed on the bid proposal MUST be registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. No contractor or subcontractor may work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. For projects awarded on or after April 1, 2015, contractor and subcontractors must furnish electronic certified payroll records to the Labor Commissioner. In addition, City has contracted with a 3rd Party Firm for its compliance monitoring on this project. Certified Payroll Records will also be electronically submitted to them on a weekly basis. The successful bidder shall pay general prevailing wage rate of per diem wages to all workers employed under this Contract. Copies of prevailing wage rates from the Department of Industrial Relations can be viewed online and are on file with the City Project Manager at Dublin City Hall. See Section GC-09 Additional State Labor Code and CWA Requirements for additional Labor reporting and compliance requirements. PREFERENCE FOR MATERIALS: Bidders may propose equals of products listed in the technical specifications or project plans by manufacturer name, brand or model number, unless the technical specifications or plans specify that the product is necessary to match others in use. Complete information for products proposed as equals must be submitted to the City Project Manager for review at least ten (10) working days before the time specified for bid opening pursuant to the bidders instructions contained in the bid package. REJECTION OF BIDS: The City of Dublin reserves the right to reject any and all bids or to waive any defects or irregularity in bidding pursuant to applicable law. Pursuant to California Public Contract Code Section 20103.8, if the City elects to award a contract for performance of the project, the contract will be awarded pursuant to California Public Contract Code Section 20162 and other applicable law to the responsible bidder submitting a responsive bid with the lowest total bid price for the base bid without consideration of the bid price for any additive or deductive items. All bids will remain valid for ninety (90) days after the bid opening. Except as permitted by law and subject to all applicable remedies, including forfeiture of bidder's security, bidders may not withdraw their bid during the ninety (90) day period after the bid opening. CITY'S RIGHTS RESERVED: The City of Dublin reserves the right to postpone the date and time for the bid opening at any time prior to the date and time announced in the advertisement pursuant to applicable law. BID INELIGIBILITY: A firm that has provided architectural or engineering services to the Department for this contract before bid submittal for this contract is prohibited from any of the following: (1) submitting a bid; (2) subcontracting for any part of the work; or (3) supplying materials to any contractor or subcontractor working on the project. COMMUNITY WORKFORCE AGREEMENT: This Project is subject to the Community Workforce Agreement approved by the City of Dublin City Council effective December 7, 2021. All Bidders shall include with their bid proposals, an executed Agreement to be Bound which can be found in Section P-20 Community Workforce Agreement (CWA) Addendum A - Agreement to be Bound. All subcontractors, at any tier, of the successful Bidder, will be required to execute the Agreement to be Bound by Section P-20 Community Workforce Agreement (CWA) Addendum A - Agreement to be Bound) within 14 days after Notice of Award, and as a condition precedent to entering into any contract for this Project.
