Upon request, the Owner shall be required to submit the certified payroll report to the SBA for review. Each contractor shall be responsible to obtain correct and fair minimum rate of wages as established by the West Virginia Division of Labour. The bidder to whom the contract is awarded shall execute and deliver to the Owner within 10 days after the award, and before signing the contract, a Performance Bond and Payment Bond utilizing the bond forms bound in the Project Manual each in a penal sum equal to at least the contract sum and the cost of such bonds shall be included in the bid. All Bidders shall furnish a valid bid bond in the amount of five percent (5%) of the total amount of the bid protecting the County Board of Education and the School Building Authority of West Virginia. The bid bond must be submitted with the bid. The Bid Bond obligee shall be the County Board of Education. d. The bond must be in the sum of one hundred percent (100%) of the amount of the contract, insuring the full and faithful performance of the work and payment in full for all materials, machinery, equipment, and labor, and covering all the guarantees called for in the specifications and all other obligations arising there under. The Owner reserves the right to reject any or all bids, the right to waive minor informalities and procedures in bidding, and the right to withhold final award of contract for 30 days after opening bids.
