Proposers wishing to submit a non-electronic proposal may do so only after receiving written authorization from MNAA. Written authorization to submit a non-electronic proposal may be requested by emailing purchasing@flynashville.com at least five (5) days prior to the date proposals are due. Proposers submitting a non-electronic proposal must submit a copy of the written authorization with their proposal package. SCOPE. Asbestos, Lead, and Mold Abatement - Scope of Work In consideration of the payment specified in this Agreement, Contractor shall provide, in a timely manner, all labor, supervision, parts, equipment, materials, tools, instruments, expendable items, supplies, reports, transportation, insurance, subcontracts, warranties, and incidentals necessary to perform services. Time is of the essence regarding the contractor's performance of services under this contract, and the time to perform, as stated in the Notice to proceed, shall control. The services will consist of the following: Asbestos Identification and Abatement Services: Contractor shall, on an as needed project basis, furnish all labor, materials, tools, equipment, supplies, and all incidentals required and or implied, unless otherwise stated in an individual project scope, for the complete and satisfactory performance of asbestos testing, removal, and disposal. Contractor shall perform all work in accordance with the most current guidelines or regulations of the responsible Metro Nashville Government Department, Tennessee State Agency, the Environmental Protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), and other applicable laws and regulations. Such work includes but is not limited to the following: Material sampling and analysis to determine absence or presence of asbestos-containing materials (ACM) in accordance with accepted industry practice. All preparation of the work areas and areas outside the work areas prior to beginning the asbestos removal work. Removal of all asbestos containing material and waste materials contaminated with asbestos during the process of the work and any other debris generated by this work. Complete cleaning and decontamination of all work areas and contents thereof. Disposal of asbestos, asbestos waste, debris, and contaminated materials generated by this work. Issuance of any requested or required certificates of re-occupancy or suitable for construction activities. Lead Identification and Abatement Services: Contractor shall, on an as needed project basis, furnish all labor, materials, tools, equipment, supplies, and all incidentals required and or implied, unless otherwise stated in an individual project scope, for the complete and satisfactory removal of materials containing lead indicated and specified on a job-by-job basis and the incidental procedures and equipment required to protect workers and personnel occupying areas adjacent to the lead work area. Contractor shall perform all work in accordance with the most current guidelines or regulations of the responsible Metro Nashville Government Department, Tennessee State Agency, the Environmental protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), and other applicable laws and regulations. Such work includes but is not limited to the following: Material sampling and analysis to determine absence or presence of lead-based paint in accordance with accepted industry practice. All preparation of the work areas and areas outside the work areas prior to beginning the lead removal work. Removal of all lead containing material and waste materials contaminated with asbestos during the process of the work and any other debris generated by this work. Complete cleaning and decontamination of all work areas and contents thereof. Disposal of lead, lead waste, debris, and contaminated materials generated by this work. Issuance of any requested or required certificates of re-occupancy or suitable for construction activities. Mold and toxic Substance Abatement Services: Contractor shall, on an as needed project basis, furnish all labor, materials, tools, equipment, supplies, and all incidentals required and or implied, unless otherwise stated in an individual project scope, for the complete and satisfactory removal of mold and toxic substances specified on a job-by-job basis and the incidental procedures and equipment required to protect workers and personnel occupying areas adjacent to the lead work area. Contractor shall perform all work in accordance with the most current guidelines or regulations of the responsible Metro Nashville Government Department, Tennessee State Agency, the Environmental protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), and other applicable laws and regulations. Such work includes but is not limited to the following: Material sampling and analysis to identify mold and other toxic substance, as necessary, in accordance with accepted industry practice. All preparation of the work areas and areas outside the work areas prior to beginning the lead removal work. Removal of all contaminated and non-redeemable materials found as well as those contaminated during the process of the work and any other debris generated by this work. Complete cleaning and decontamination of all work areas and contents thereof. Disposal of toxic/contaminated materials generated by this work. Issuance of any requested or required certificates of re-occupancy or suitable for construction activities. Other Miscellaneous and Other Hazardous Materials Removal/Abatement Services: Other areas of service may be needed from time-to-time involving materials/items such as radon gas, light fixture ballasts, fluorescent lamps, mercury-containing devices, freon-containing devices, chemicals, bloodborne pathogens, and human waste, among others. On as as-needed project basis, for such materials/items, contractor will furnish all labor, materials, tools, equipment, supplies, and all incidentals required and/or implied, unless otherwise stated in the individual project scope, for the complete and satisfactory performance of removal and disposal. Contractor shall perform all work in accordance with the most current guidelines or regulations of the responsible Metro Nashville Government Department, Tennessee State Agency, the Environmental protection Agency (EPA), the Occupational Safety and Health Administration (OSHA), and other applicable laws and regulations. Contractor will be required to perform personnel breathing zone testing and exposure testing throughout the remediation process. The SMWBE participation level established for this Contract will be 4.96% MBE and/or WBE. MNAA proposes to award the Contract to the lowest responsive and responsible Proposer, provided it has met the goals for SMWBE participation or, if failing to meet the goals, has made an acceptable good faith effort to meet the established goals for the SMWBE participation. Proposer is advised that MNAA reserves the right to reject any and all Proposals submitted, to waive any and all informalities, irregularities and/or technicalities in any Proposal or Proposal Guaranty, to accept any Proposal deemed advantageous to it and to negotiate changes, deletions, or additions to these Contract Documents with the successful Proposer.
