You are invited to review and respond to this Invitation for Bid # 3340-C3619103474 for Parking Lot Slurry Seal Project, offered by the California Conservation Corps, Business Services and Contracts Office. Bids are permitted for only State Certified Businesses. Note that all agreements entered with the State of California will include by reference General Terms and Conditions (GTC 04/2017) and Contractor Certification Clauses (CCC 04/2017) that may be viewed and downloaded at the following internet site. If you do not have Internet access, a hard copy can be provided by contacting the Acquisition Analyst listed below. Bidders are encouraged to carefully read the entire solicitation. The need to verify all documentation and responses prior to the submission of bids is the responsibility of the bidder and cannot be overemphasized. Please ensure insurance requirements and, if applicable, prevailing wages are considered in your bid amounts. All workers employed on public works projects must be paid the prevailing wage determined by the Director of the Department of Industrial Relations, according to the type of work and location of the project. The prevailing wage rates are usually based on rates specified in collective bargaining agreements. Should prevailing wage be required, refer to DIR's website. On March 4, 2022, Governor Gavin Newsom issued Executive Order (EO) N-6-22 regarding Economic Sanctions against Russia and Russian entities and individuals. "Economic Sanctions" refers to sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law. By submitting a bid, Bidder represents that it is not a target of Economic Sanctions. Should the State determine Bidder is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for rejection of the Bidder's bid any time prior to contract execution, or, if determined after contract execution, shall be grounds for termination by the State. GenAI Disclosure The State of California seeks to realize the potential benefits of Generative Artificial Intelligence (GenAI), through the development and deployment of GenAI tools, while balancing the risks of these new technologies. Bidders/Offerors must notify the State in writing if their solution or service include, or makes available, any GenAI technology, including GenAI from third parties or subcontractors. The State has developed a GenAI Disclosure and Factsheet (STD1000) to be completed by the Bidder/Offeror. Failure to disclose GenAI to the State and submit the GenAI Disclosure and Factsheet will result in disqualification of the Bidder/Offeror and may void any resulting contract. The State reserves its right to seek any and all relief it may be entitled to as a result of such non-disclosure. Upon receipt of a Bidder/Offeror GenAI Disclosure and Factsheet, the state reserves the right to incorporate GenAI Special Provisions into the final contract or reject bids/offers that present an unacceptable level of risk to the state. Mujib Sultani Business Services and Contracts 1719 24th Street Sacramento, CA 95816 916-341-3157 Mujib.Sultani@ccc.ca.gov General Scope of Work: Slurry Seal shall consist of mixing asphalt emulsion, aggregate, and water and spreading the mixture on a surfacing or pavement where shown on the plans, as noted in these specifications and the special provisions. A site plan will be provided at job walk indicating the areas to be slurry sealed. The contractor will meet with local staff to coordinate the project work and provide a project timeline. See Model Contract, Exhibit A for the detailed scope of work. (page 25 - 33) Project Term: upon approval License: Contractors' State License Classification required to bid Project is C-12 Health and Safety Provisions: Contractor and all subcontractors shall abide by all health and safety mandates issued by federal, state, and local governments and/or public health officers as well as those issued by DGS, and worksite specific mandates. If multiple mandates exist, the Contractor and subcontractors shall abide by the most restrictive mandate. The term "employee", "worker", "state worker", or "state employee", in health and safety mandates includes contractor and subcontractor personnel. Costs associated with adhering to health and safety mandates are the responsibility of the contractor. Contractor is responsible for the tracking and compliance of health and safety mandates and may be audited upon request. Availability of Funds: Award of this contract is subject to the availability of funds through the State's normal budget process. Failure to attend, or provide representation to, the mandatory bid-walk will result in the bidder's bid submittal being rejected from the bidding process. Any interested bidder or bidder's representative who requires reasonable accommodation to participate in the mandatory bid-walkthrough, must contact the Mujib Sultani, identified above at least 5 days prior to the mandatory bid-walk date. It is recommended that all vendors register as a bidder through the Cal eProcure website. This will allow for automatic notifications if there is any modification to the Event such as the posting of an addendum or additional documentation. Bid: Submit Lump Sum basis and possible breakdowns as set forth in Bid Forms. Bonds: If applicable, performance and payment bond documents will be required post award, in the amount of 100 percent of the contract price. Include estimate cost of bonds within your bid total. Performance bond is not required for one-time lump sum payment terms. It is required for progress payments. Payment terms are determined by the CCC project manager Payment bond (STD 807) is required for bids in excess of $25,000 and $15,000 for maintenance bids. Non-Discrimination Program (GC, Section 12990): refer to General Conditions of Contract for Construction. Labor Code: Pursuant to Labor Code, Section 1774, the Contractor to whom the contract is awarded, and any subcontractor under them, shall pay not less than the specified general prevailing rates of per diem to all workers employed in the execution of the contract. Pursuant to Labor code, Section 1770 et seq., the Department of Industrial Relations (DIR) has ascertained general prevailing rate of per-diem wages are available from the DIR, Labor Statistics & Research Division, P.O. Box 420603, San Francisco, CA 94142, (415) 703-4780; or general prevailing rate of per-diem may be accessed on the internet at website for the published general prevailing rate of per diem wages. Copies of the general prevailing rate of per diem wages are on file at DGS' principal office, which shall be made available to any interested party on request. Note that when the general prevailing rate of per diem determination shows an expiration date (noted by a double asterisk**), to expire during the term of the contract, the Contractor must call or write the DIR to obtain the new rates and incorporate them in this contract for submittal of bid. The Contractor is responsible to comply with the Labor Code Sections and general prevailing rate of per diem determinations, including all the guidelines and the fine print in the general prevailing rate of per diem determinations. Refer to Project Manual section, General Conditions of the Contract for Construction. Labor Compliance Monitoring and Enforcement: This project is subject to monitoring and enforcement by the Department of Industrial Relations (DIR), Compliance Monitoring Unit. All Contractors and subcontractors, regardless of tier, shall be required to comply with the Monitoring and Enforcement Program, including, but not limited to, contractor registration, submittal of electronic certified payroll reports directly to the DIR as applicable and cooperation with on-site monitoring by DIR personnel. Refer to Labor Code 1771.4 et seq. and the General Conditions of Contract for Construction for more information. Anticipated Intent to Award 05/20/2024
