Sonoma Developmental Center (SDC) is soliciting for service under the authority of Public Contract Code Section 10340. Bidders are invited to review and respond to this Invitation for Bid (IFB), entitled SN249002 "Street Sweeper ". To submit a bid, you must comply with the instructions contained in this document as well as with the requirements stated in the Agreement, Exhibit A, Scope of Work. By submitting a bid, your firm agrees to the terms and conditions stated in the IFB. Please read all portions of this solicitation thoroughly. The Bidder is solely responsible for ensuring that SDC receives the complete bid in accordance with the Bid requirements, prior to the date and time specified in the solicitation. Bids received after the specified deadline will not be considered for review. SDC shall not be responsible for any delays in submittal, including missed deliveries. SDC reserves the right to cancel this IFB without cause at any time prior to award. Note that all agreements entered into with SDC (also referred to as State of California and/or State), will include by reference General Terms and Conditions (GTC 04/2017) that may be viewed and downloaded at this Internet site: website and Contractor Certification Clauses (CCC 04/2017). If you do not have Internet access, a hard copy can be provided. Public or private corporations, agencies, organizations, or individuals may submit a sealed bid in response to this IFB. The bidder must be legally constituted and qualified to do business within the State of California (registered with the California Secretary of State), if applicable. Bidder must be a legally cognizable public agency, sole proprietorship, partnership, or corporation (fully incorporated by the deadline for submitting bids). Failure to meet the foregoing requirement will result in disqualification. Bidders, including the bidders' representatives such as executives, officers, board members, and agents, must be responsible and have the capability to professionally carry out the terms of this agreement. Those bidders/bidder representatives who have had a contract terminated with SDC or DDS facilities in the past 18 months will be disqualified and will not be considered in the award process. This restriction extends to any and all entities for which the bidder representatives have been responsible in whole or in part (e.g., making decisions, managing operations) Sonoma Developmental Center (SDC) is waiving the Disabled Veteran's Business Enterprise (DVBE) participation requirements for this agreement. However, the DVBE incentive is still in effect for this solicitation. Please see page 8, Section D, Participation, Preference and Incentive Programs. In the opinion of SDC, this Invitation for Bid is complete and without need of explanation. However, if questions arise or there is a need to obtain clarifying information, bidder shall submit and email by the Questions Submittal Deadline in Section C., Bid Requirements and Information - Key Action Dates Please note that no verbal information given will be binding upon SDC unless such information is issued in writing as an official addendum. Executive Order N-6-22-Russia Sanctions On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (the EO) regarding Economic Sanctions against Russia and Russian entities and individuals. "Economic Sanctions" refers to sanctions imposed by the U.S. government in response to Russia's actions in Ukraine, as well as any sanctions imposed under state law. By submitting a bid or proposal, Contractor represents that it is not a target of Economic Sanctions. Should the State determine Contractor is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for rejection of the Contractor's bid/proposal any time prior to contract execution, or, if determined after contract execution, shell be grounds for termination by the State. A) Description of Services Contractor agrees to provide all parts, labor, tools, equipment, and transportation necessary to provide street sweeping. See Exhibit A, Scope of Work (SOW) for a complete description of services to be provided. Agreement Term The term of this Agreement will be for one (1) year with the option to amend to add one (1) additional year, add funds, and increase or decrease services as deemed necessary by SDC. The rates on Attachment 4- Cost Worksheet, will not change as a result of any amendment to this Agreement. This Agreement may be terminated by SDC with thirty (30) days' written notice to the Contractor. Contractors are cautioned that no work will begin until the Agreement has been fully executed. If work is performed prior to agreement approval, and the Agreement for any reason is not approved, all previous work performed by the Contractor is considered donated to SDC and no payment shall be made for that work. B) Bidder Minimum Qualifications To be responsive to this IFB, the following requirements must be met. NOTE: Bid submissions that do not meet the IFB requirements as stated may be rejected. Bidder must complete, sign (where applicable), and return all attachments, including any required supporting documentation (e.g., references, certifications, licenses, insurance acknowledgement, Secretary of State) necessary to validate the Bidder's qualifications. 1) Attachment 2, Bidder Certification Sheet must be signed by an individual authorized to bind the business contractually and must identify the title or position that the individual holds in the business. 2) Complete and submit all required attachments listed on the Attachment 1, Required Attachment Checklist. 3) Bidder may not bid for work of any kind that the bidder is not properly licensed. Any such bid received will be disqualified. 4) Bidder must be in good standing with the Secretary of State's office. 5) Bidder must maintain appropriate types and levels of insurance per Exhibit D, "Special Terms and Conditions." 6) Bidder must be licensed by the State of California. 7) Contractor must have a minimum of two (2) years of experience. 8) If Contractor subcontracts to another vendor, the subcontractor must meet the license and qualification requirements noted above and the provisions outlined in Exhibit D "Special Terms and Conditions." 9) Contractor must provide prior to the implementation of this contract the contact information for three (3) references who can verify that within the past five (5) years contractor performed services similar to those outlined in this Scope of Work. 10) Bidder must provide a copy of their unexpired California city or county business license (if applicable); or, if their corporation located within the State of California, incorporation documents; or letter from the Secretary of State or, if not a California business, an affidavit that the business is in good standing with the state, province, or country in which the business is headquartered. 11) Bidders shall obtain, at their expense, all license(s) or permits required by law for accomplishing any work required in connection with this agreement. 12) All licenses must remain valid for the term of the Agreement. If any license or certification expires at any time during the term of this agreement, the Contractor agrees to provide SDC with a copy of the renewed license or certification within 30 days following the expiration date. In the event the Contractor fails to keep in effect at all times all required licenses or certifications, SDC may, in addition to any other remedies it may have, terminate this agreement upon occurrence of such event. In the event a potential prime contractor is unable to attend the non-mandatory pre-bid conference/walkthrough, an authorized representative may attend on their behalf. The representative may only sign in for one company. Subcontractors may not represent a potential prime contractor at a non-mandatory pre-bid conference/walkthrough. For contractors that need assistance due to a physical impairment, a reasonable accommodation will be provided by the awarding agency upon request for the pre-bid conference/walkthrough. The Contractor must call Valerie Dunn at (707) 938-6113 no later than the fifth working day prior to the scheduled date and time of the pre-bid conference to arrange for a reasonable accommodation. 1. Email #1 (Bid) must include the Bidder's submission in PDF format with the subject line identifying the submission as BID-Company Name. Bids must be formatted for 8 1/2 " x 11" paper with all pages consecutively numbered, each required element clearly identified, and in the sequence presented in this IFB. 2. Email #2 (Attachment 4, Cost Worksheet) must include Bidder's cost sheet in PDF format with subject line identifying the submission as COST-DO NOT OPEN. 3. The Cost email shall remain unopened and separate from the sealed bid email until the public cost opening. b) Bids not submitted as instructed may be rejected. c) All bids shall include the documents identified in Attachment 1, Required Attachment Checklist. Bids not including the proper required attachments may be deemed nonresponsive. A nonresponsive bid is one that does not meet the basic bid requirements. d) Electronic signature of the person authorized to bind the Bidder to this agreement is acceptable. Bids submitted without authorized signatures on all forms requiring signature may be rejected. e) It is the Bidder's responsibility to provide all necessary information for SDC to evaluate the Bid, verify requested information, and determine the Bidder's ability to perform the services defined in the Agreement in Exhibit A, SOW and Attachment 4, Cost Worksheet. f) Bids must be submitted for the performance of all the services described herein. Any deviation from the work specifications will not be considered and will cause a bid to be rejected. g) SDC may rejected any and all bids. A bid may be rejected if it is conditional or incomplete. SDC is not required to award a contract. h) A bid can be rejected if it is conditional or incomplete or if it contains any alterations of form or irregularities of any kind. SDC and/or the State of California may reject any or all bids and may waive an immaterial deviation in a bid. SDC and/or the State of California's waiver of an immaterial deviation shall in no way modify the IFB document or excuse the bidder from full compliance with all requirements if awarded the contract. In SDC's sole discretion, a bid that is not complete or is determined nonresponsive may not be considered.
