Section II - Vicinity of Rossburn Application of Graded Chip Seal and Fog Seal on Provincial Road 577 From 10.3km East of Provincial Road 264 to Provincial Road 264, for a Total Construction Distance Approximately 10.3kms in the Municipality of Rossburn. Section III - Vicinity of Shilo Application of Graded Chip Seal and Fog Seal on Provincial Road 457 From Provincial Road 468 to Provincial Road 340, for a Total Construction Distance Approximately 8.6kms in the Municipality of Cornwallis. Completion Model The Contractor Shall Be Assessed Liquidated Damages in Accordance With the Specification for Liquidated Damages - Completion Specified by Completion Date. Liquidated Damages The Work Must Be Completed by No Later Than August 12, 2024. Daily Liquidated Damages After This Specified Completion Date Will Be Charged to the Contractor at the Rate of Four Hunrded ($400.00) Dollars Per Calendar Day Until the Work is Completed. In Addition to the Daily Liquidated Damages, a Lump Sum Liquidated Damage of One Hundred Thousand ($100,000.00) Dollars Will Be Charged to the Contractor if the Work is Not Completed by August 26, 2024. In Addition the Lump Sum Liquidated Damages Will Be Charged to the Contractor on a Recurrent Annual Basis Until Substantial Completion. Seasonal Shutdown Date The Seasonal Shutdown Date for This Project is: August 26, 2024. The Assessment of Liquidated Damages Will Cease Between the Later of August 26, 2024, or the Actual Date the Contractor Completes the Graded Chip Seal and Fog Seal for the 2024 Construction Season, and Will Resume on June 2, 2025, or the Actual Day the Contractor Recommences Chip Sealing for the 2025 Construction Season and Will Accrue Until the Contract is Completed.
