Each bid shall be accompanied by a Bid Security in the form of a certified check, cashier's check, money order or bid bond made payable to ATA in an amount not less than five percent (5%) of the base bid as a Bid guarantee. All bidders must provide familial disclosure in compliance with MCL 380.1267 and attach this information to the bid. The bid shall be accompanied by a sworn and notarized statement disclosing any familial relationship that exists between the owner or any employee of the bidder and any member of the board or chief executive officer of the public-school academy The successful Bidders whose proposals are $50,000 or more will be required to furnish a U.S. Treasury Listed Company Performance and Payment Bond in the amount of 100% of their bid. The cost of such bonds shall be included in the Bid. The bid security of Bidders under construction will be returned immediately after execution of the Contract by the Owner. The amount of the bid security shall be forfeited to the Owner if the successful bidders fail to enter into a contract and furnish required bonds and insurance certificates within ten (10) days after award of Contract. Withdrawal of any bid is prohibited for a period of sixty (60) days after the actual date of the opening thereof. Each Bidder agrees to waive any claim it has or may have with the Owner, the Architect, and their respective employees, arising out of or in connection with the administration, evaluation, or recommendation of any bid. The owner reserves the right to reject any or all bids, either in whole or in part, to reject a bid not accompanied by the required bid security or by other data required by the bidding documents or to reject a bid which is in any way incomplete or irregular. The owner reserves the right to accept alternates in any order or combination and to determine the lower Bidder on the basis of the sum of the base bid and the Alternates accepted. The Owner reserves the right to negotiate with any bidder without re-bidding the project in whole or in part. The Owner reserves the right to accept or reject any and all proposals on such basis as the Advanced Technology Academy deems to be in its best interest to do so and to award the bid to other than the low bidder. The owner reserves the right to waive informalities, irregularities and or errors in the bid proposal.
