The work shall include resurfacing, striping, sidewalk, and handicap ramp improvements. More specific details are in the Specifications and Contract Documents. Bids may be withdrawn by written request only if the request is received prior to the time and date set for the opening bids. Negligence on the part of the bidders in preparing his bid confers no right of withdrawal or modification of his bid after bid has been opened. No bid may be withdrawn for a period of ninety (90) days after the time and date of opening of bids. The Contractor shall provide the necessary labor, construction equipment, fuel, materials, and any other items and/or appurtenances required for a successful and complete project. All Work shall conform to the Project Specifications and all applicable local, state and federal codes and regulations. Contract time shall be 180 consecutive calendar days from the date of a Formal Notice to Proceed from the City of St. Marys. The Bid Bond shall be in the amount of not less than 5% of the total amount payable by the terms of the Contract. No bid shall be read aloud or considered if a proper Bid Bond has not been Submitted. The City of St. Marys will select the bid that, in its sole discretion is the most responsive and responsible to the City. The City is not liable for any cost incurred by vendors in the preparation of this bid. The Owner reserves the right to reject any or all bids, to waive informalities and to re-advertise, pursuant to federal and state law. WITHDRAWAL OF BIDS: Bids may be withdrawn at any time prior to opening upon written or telegraphic request of the Proposer. Negligence on the part of the Bidder in the preparation of its bid shall not be grounds for modification or withdrawal of a bid after the time set for Bid opening. AWARD OF CONTRACT: 1) The City of St. Marys reserves the right to accept or reject any and/or all bids received, to waive irregularities and informalities in this Invitation to Bid, and to make award in any manner deemed in the best interest of the City of St. Marys and to re-advertise pursuant to federal and state law. 2) Any Bidder that contacts elected officials or staff directly or indirectly for the purpose of influencing the selection process prior to a contract award shall be immediately disqualified and removed from consideration. 3) The contract award is determined by Mayor and Council at their regularly scheduled Council Meeting. Staff will make a recommendation for award and present the bid results. Council makes the final decision. Vendors should not rely on verbal suggestions from staff as to who will be awarded. Performance Bond Requirements The Performance Bond shall be in the amount of at least the total amount payable by the terms of the Contract. All required Contract Documents and proof of meeting the City's Insurance Requirements must be fully completed and executed by the Contractor and his/her Surety, and submitted to the Owner on or before the issuance of Notice to Proceed.
