Last Date for Questions: March 24, 2025 PROJECT INTRODUCTION Flathead County (Owner), is seeking a qualified General Contractor / Construction Manager (GC/CM) firm to undertake preconstruction services, and potentially construction services for a new Public Safety Facility in Kalispell, Montana. The project consists of a new 250-bed Adult Detention Center and potentially a Sheriff's Department Administration. The project will be located at 225 Snowline Lane, Kalispell, Montana. Owner intends to enter into a GC/CM Contract for Preconstruction Services. The GC/CM contract will include, but not be limited to: (i) Preconstruction Services (generally described in Section III, below); (ii) a maximum Preconstruction Services Fee; (iii) a GC/CM Fee and Fixed Costs for General Conditions Work; and (iv) provisions for Owner, at Owner's sole discretion, to add Construction Services (generally described in Section IV, below) by acceptance of a Guaranteed Maximum Price ("GMP") by contract amendment. The GMP amendment and GMP would include construction services through completion of the Project. Alternatively, Owner may, at its sole discretion, choose not to continue the GC/CM contract beyond the completion of preconstruction activities, and instead solicit bids from qualified contractors for construction services and the construction of the Project. The process for the development of the design and delivery of the Project will be a collaborative process. When selected, the GC/CM will function as part of a team composed of the Owner and/or Owner's Representative(s), Architect(s), Engineer(s), and others as determined by the Owner. The Owner will use the RFQ/P process to evaluate each of the Proposers' qualifications. Final selection will be determined from the deliverables submitted in response to the RFQ/P document, interviews, and any other information sought by the Owner to assess a firm's ability to complete the project as required. This RFQ/P shall not commit the Owner to enter into any agreement, to pay any expenses incurred in preparation of any response to this RFQ/P, or to procure or contract for any supplies, goods, or services. The Owner reserves the right to accept or reject any and all responses received as a result of this RFQ/P. Design/Construction: The selected GC/CM will be expected to begin preconstruction services immediately. Due to the uncertainty of project financing through a voted bond issue, the final project schedule will be set with the team once the project bond issue has been approved by voters. The Owner intends to put the bond issue on the ballot in November 2025. The following schedule is estimated based on the bond issue being approved in November 2025. GC/CM Preconstruction Services: May 2025 - March 2026 Schematic Design: March - May 2025 Design Development: June - September 2025 Construction Documents: October 2025 - February 2026 Voted Bond Issue: November 4, 2025 Bidding, GMP, Contracts: March - April 2026 Commence Construction: May 2026 Construction Completion: November 2028 SCOPE OF CONSTRUCTION SERVICES It is anticipated that the GMP will be established after completion of Construction Documents and after the project is bid (not including any Early Work Amendments). The established GMP will be the maximum amount paid for the construction unless scope changes are requested and approved by the Owner. Owner's acceptance (if accepted) of the GMP by contract amendment (a "GMP Amendment") will constitute completion of preconstruction services and that GMP Amendment will initiate the Construction period for the Project where the GC/CM will take the role as General Contractor and Construction Manager. At the time of execution of the GMP Amendment, the GC/CM will be required to submit a 100% Performance and 100% Payment bond for the completion of the specified Project. Failure of the GC/CM to obtain the applicable bonding will result in termination of the GMP Amendment. The Owner shall not be obligated to enter into a GMP Amendment with the GC/CM. The Owner retains the option to cancel the Construction Services; to start a new selection process for the Construction Services of the Project; to terminate the contract and negotiate a replacement contract with the next highest-rated-Proposer from this solicitation; and/or to issue the project for award to the lowest responsible bidder. The selected GC/CM will be required to pay State of Montana Prevailing Wages. The selected GC/CM will be required to comply (as a minimum allowable rate schedule) with those rates adopted and effective at the time of signing the GMP Amendment. All reporting, documentation, etc. shall remain as per the State of Montana's requirements. This project is subject to all State requirements as outlined in the Montana Code Annotated (MCA).
