The Work to Be Bid Upon is Generally Described as Follows: Contract No. 713-01-23: Valley Pk-8 School - Flood Repairs Project 200 Lf of H-pile Retaining Wall and Associated Infrastructure, Site Work, and Restoration Prospective Bidders Are Advised That the Contract Awarded Under This Advertisement for Bids is to Be Funded in Whole or in Part by the State of West Virginia, Fayette County Board of Education, and Federal Emergency Management Agency (Fema). Neither the State of West Virginia or the United States Nor Any of Its Departments, Agencies, or Employees is or Will Be a Party to This Advertisement for Bids or Any Resulting Contract. Equal Employment Opportunity Bidders on This Work Will Be Required to Comply With All Applicable Standards, Orders or Regulations in Accordance With Executive Orders 11246 and 11375, Which Prohibit Discrimination in Employment Regarding Race, Creed, Color, Sex, or National Origin. Davis-bacon Act Davis-bacon (Federal) Prevailing Wage Determinations Must Be Used in Addition to Any State Prevailing Wage Rates. The Contractor Shall Use the Higher Rate for Each Job Classification (Between State Wage Rates and Davis-bacon Wage Rates) for Paying Labor Employed in the Construction of This Project. Copeland "anti-kickback" Act Bidders on This Work Will Be Required to Comply With 18 U.s.c. 874, 40 U.s.c. 3145, and the Requirements of 29 C.f.r. Part 3 as May Be Applicable. Contract Work Hours and Safety Standards Act Bidders on This Work Will Be Required to Comply With Statutory Requirements on Work Hours and Safety Standards. Under 40 U.s.c. 3702, Each Contractor Must Base Wages for Every Mechanic and Laborer on a Standard 40-hour Work Week. Work Over 40 Hours is Allowed, So Long as the Worker is Paid at Least One and a Half Times the Base Pay Rate for All Hours Worked Over 40 Hours in the Work Week. Additionally, for Construction Work, Under 40 U.s.c. 3704, Work Surroundings and Conditions for Laborers and Mechanics Must Not Be Unsanitary or Unsafe. Relevant Definitions Are at 40 U.s.c. 3701 and 29 C.f.r. 5.2. Clean Air Act Contractors Are Required to Comply With All Applicable Standards, Orders or Regulations Issued Pursuant to the Clean Air Act, as Amended, 42 U.s.c. 7401 Et Seq. Suspension and Debarment Recipient Shall Not Entertain the Use of Businesses That Are Listed on the "excluded Parties List System" at Www.epls.gov in Accordance With 2 Cfr Part 1532 and Subpart B and C of 2 Cfr Part 180.
