Site work for a water / sewer project in Ferguson, Missouri. Completed plans call for site work for a water / sewer project.

The Bid Proposal shall be prepared on a Proposal Form, provided by the District, in accordance with Section 2.3, FORM OF PROPOSAL, of the General Project Specifications, Bids not submitted on District provided forms will be rejected. The proposal shall be accompanied by a certified check or cashier's check on a bank or trust company in St. Louis County or in the City of St. Louis or by a bidder's bond, for an amount not less than five (5%) percent of the bid amount as bid security to the District. The work to be done under this contract consists of the construction of approximately 725 lineal feet of natural channel stabilization, 350 lineal feet of modular block wall, 29 lineal feet of storm pipe sewers 12-inch to 24-inch in diameter, and appurtenances to be constructed in an area located south of Interstate 270 and west of West Florissant Avenue, in the City of Ferguson, Missouri. The Engineers Opinion of Probable Cost for this project is $1,630,000. If, within twenty-four (24) hours after bids are opened, any bidder files a duly signed, written notice with the Executive Director along with supporting documents that demonstrates to the reasonable satisfaction of the District that there was a material and substantial mistake (other than judgment) in the preparation of its Contact the Project Engineer, Jennifer Gerwitz, at 314-335-2036, Regarding Technical Questions. If You Have Questions or Recommendations Concerning the District's Mwbe Program, Please Contact Shonnah Paredes, Manager of Diversity Programs, at (314)768-6395 or by Email at Sparedes@stlmsd.com In connection with the furnishing of supplies or performance of work under this Contract, the Contractor agrees to comply with the Fair Labor Standard Act, Fair Employment Practices, Equal Opportunity Employment Act, and all other applicable Federal and State laws and further agrees to insert the foregoing provisions into all subcontracts awarded hereunder. The Contractor will take affirmative action to ensure that applicants for employment and employees are treated equally, during employment, without regard to their race, color, religion, sex or national origin. Such action will include, but not be limited to, the following: employment upgrading, demotion or transfer, recruitment advertising, layoff or termination, rates of pay or other forms of compensation, and selection for training, including apprenticeship. Likewise, the Contractor shall not discriminate against any employee or applicant for employment if qualified. Further, the Contractor shall take affirmative action to employ and advance qualified veterans of the Vietnam era. Contractor agrees to post in a conspicuous place available to employees and applicants for employment, notices setting forth the provisions of this non discrimination clause. In the event of the Contractor's non-compliance with the provisions of the subparagraphs above, this Contract may be canceled, terminated or suspended in whole, or in part, and the Contractor may be declared ineligible for further District Contracts. The rights and remedies of the District provided in this subparagraph will not be exclusive but are in addition to any remedies provided in this Contract or a provided for by law. Within fifteen (15) days after acceptance of the bid proposal, the successful bidder must have on file Certificates with the District that he has obtained, and will continue to carry, Comprehensive Automobile Liability, Workers' Compensation, and Comprehensive General Liability Insurance as required by the contract documents. The District reserves the right to require the successful bidder to file proof of his ability to properly finance and execute the project, together with his record of successful completion of similar projects. The successful bidder, whose proposal has been accepted, shall sign the Contract in duplicate, and return the signed documents within fifteen (15) days after the date of their receipt. At the same time the successful bidder shall also file with the District two (2) copies of both a Contract Bond for one hundred (100%) percent of the contract amount, and an acceptable Certificate of Insurance and Insurance Binder or policy for the required insurance coverage. J. The Contractor shall commence work within ten (10) days after the date of written notice from the District to begin and shall complete all work within two hundred sixty-five (265) calendar days after the expiration of such ten (10) day period. If the Contractor does not comply with the foregoing without a written, District approved explanation he may be removed from the list of eligible bidders for future District construction projects until further notice. The sewers will be constructed in public rights-of-way and in easements previously secured by the Sewer District. The District reserves the right to eliminate some of the construction work throughout the project, either before or after entering into a contract. No claim will be allowed for anticipated profits or damages in connection with any work so eliminated by the District, provided the total value of changes together with all previous changes, is not in excess of twenty-five (25%) percent of the original monetary amount of the bid proposal and/or contract. All prospective bidders must pre-qualify and be certified prior to either receiving specifications and plans or submitting a bid proposal. Prequalification forms may be obtained at the District's website: ONLINE: Doing Business With Us, Under Capital Improvement & Replacement Program (CIRP). All bidders must obtain specifications and plans in the name of the entity submitting the bid. Payments will be made in cash on monthly estimates, less previous amounts paid, less five (5%) percent retained. A final payment will be made as detailed in the contract agreement. The successful bidder and contractor will be furnished without cost, not more than one (1) set of plans and specifications for the project. If more are requested, additional sets will be furnished upon payment of the stated charges for plans and specifications. Any plans and specifications required for permits by a municipality or other public agency will be furnished by the District. The Metropolitan St. Louis Sewer District (District) has established subcontractor goals for Building Construction (21% MBE and 10% WBE) and Non-Building Construction (10% MBE and 10% WBE) in the amount of $50,000 or more. Workforce goal requirements of 37% Minority, 11% Women, and 46% Apprentice (when applicable) apply to contracts in the amount of $500,000 or more. The requirements are further explained in the attached Business Diversity Utilization and Workforce Program document. The District reserves the right to reject any and all bids, offers or proposals submitted, to accept the proposal that it deems to be to its best interest, or to advertise for new bids. The District reserves the right to defer the acceptance of any proposal and the award and execution of a contract for a period not exceeding ninety (90) days after the date of opening the bids.
