The successful Bidder will be required to provide a Labor and Materials Payment Bond, and Performance Bond. Bonds for 100% of the contract amount must be written with a company qualified to do business in Massachusetts and acceptable to the Awarding Authority. All bidders are required to submit a bid deposit equal to 5% of the value of the total bid. The minimum wages to be paid for all labor on the project are established in a schedule issued by the Department of Labor and Workforce Development, in accordance with Section 26A - 27D, of Chapter 149 of the M.G.L., as amended, said schedule being made a part of the Contract Documents. Section 6(f) of Chapter 64H of Massachusetts General Laws exempts Massachusetts sales tax on building materials and supplies to be used in the project, and bidders shall not include in their bids any amount therefore. The contract will be awarded under the provisions of M.G.L. c. 149 to the lowest cost responsible and responsive bidder offering the lowest total price. The District reserves the right to reject any and all bids, or to award or not to award the contract for any reason the Business Manager determines to be in the District's and/or the public's best interest.
