The City of New Smyrna Beach shall accept sealed proposals for23-24-CRA Mary Avenue Tot Lot Improvements from qualified Contractors licensed to do business in the State of Florida. The purpose of this Request for Proposal (RFP) is to replace the existing playground equipment for the Mary Tot Lot located at 505 Mary Avenue, New Smyrna Beach, Florida, 32168. If an award is made it shall be made to the best overall proposer(s) whose proposal is most advantageous to the City, taking into consideration the evaluation factors set forth in this RFP. The City shall not use any other factors or criteria in the evaluation of the proposals received. The successful proposer will hereinafter be referred to as the "Contractor". The City of New Smyrna Beach, Florida (the "City") is requesting sealed proposals from qualified Contractors to provide playground equipment and installation services as listed in the City's specifications. This is a federally assisted project and is subject to Federal Labor Standards which include, the Davis-Bacon Act (payment of prevailing wage rates) and the Copeland Act (anti-kickback of wages & submission of weekly certified payroll reports), as well as other provisions including 24 CFR 85.36 (bonding requirements), and Section 3 & M/WBE. Laborers and mechanics employed by primary contractors and sub-contractors performing construction work on this project shall be paid wages at rates not less than the prevailing rates as determined by the Secretary of Labor in accordance with the Davis-Bacon Act. The prime contractor is responsible for the enforcement of wage compliance and support documentation for the duration of the project and may be held liable for wage restitution. The applicable information regarding the laws and regulations stated above are included in the bid packet. The award of this contract will be contingent upon the concurrence of the City and funding partners. All required documents shall be completed and submitted through the City's eProcurement Portal. Provide and install a modern playground encompassing as much natural shade as possible. Shall include a primary color themed playground for children age's two (2) to twelve (12) years old. The new playground equipment design and layout should incorporate the latest in playground design philosophy and technology addressing the physical and creative needs of children of multiple ages. The playground equipment setbacks and fall zone criteria are to be constructed per latest U.S. Consumer Product Safety Commission (CPSC) Public Playground Safety Handbook. The playground shall be accessible to all children and meet all current ADA compatibility requirements at a minimum, with ADA inclusive features possible within the funding amount. Project includes a 160 LF of rubberized pathway (minimum 36 inches wide, 6 inches thick, or accepted material meeting fall zone criteria for ADA accessible to playground equipment. Cross-slopes must not exceed 2% and running slopes (longitude) to not exceed 5% slopes per ADA. Total rubberized area 515 SF. Project shall represent New Smyrna Beach with a new modern playground structure that fits in with its surroundings. Project resulting in a low maintenance and high durability is extremely important.
