Orion Street NW Improvements, Phase 1 Each bid shall be accompanied by a bid guaranty form of: (1) a certified check, or cashier's check, or letter of credit, equal to 10% of the bid; or (2) a bid guaranty bond for the full amount of the bid; both form of guaranty as provided in Chapter 153 of the Ohio Revised Code and in the Project Specifications. The amount of the bid for said guaranty purposes shall include all additive alternates. All bid guarantees shall be conditioned that if the bid is accepted within sixty (60) days of the bid opening, a proper Contract shall be executed, and that upon failure or refusal to enter into said Contract within ten (10) days after receipt of notification of award, the bidder and surety on any bond shall be liable to the township in an amount not to exceed ten percent (10%) of the bid. No bidder may withdraw his Proposal for a period of sixty- (60) calendar days after date and time of receipt of bids, except as provided by State Law. The Plain Township Trustees declare that they will award the contract for this project to the lowest and best bid which may not necessarily be the lowest bid. Each bidder must ensure that all employees and applicants for employment are not discriminated against because of race, color, religion, sex, handicap, or national origin. All contractors and sub-contractors involved with this project will, to the extent practicable, use Ohio products, materials, services, and labor in the implementation of their project. Additionally, contractor compliance with the equal employment opportunity requirements of the Ohio Administrative Code Chapter 123, the Governor's Executive Order 84-9 shall be required. The Plain Township Board of Trustees reserves the right to reject any or all bids, and/or waives informality in any bid, and to accept any bid or combination of bids which deemed most favorable to the Township at the time and under the conditions stipulated.
