The 2024 Cement Lining Program involves cleaning and cement lining of approximately 14,860 lineal feet of 6" cast iron water mains in the Towns of Greece and Pittsford. The work also includes the installation of temporary bypass pipe, replacing or installing valves, hydrants and appurtenances. Pursuant to Article 6 of the General Conditions, the successful Bidder, before executing the Contract, shall furnish a Performance Bond and a Labor and Materials Payment Bond ("Payment Bond") to the satisfaction of the Authority, both in the sum of the full amount of the Contract, to insure the faithful performance of the Work. Pursuant to N.Y. Public Auth. L. 1108, the Authority may require such other security as it deems necessary, as set forth in the Supplemental Conditions. Question Deadline 07/09/2024: Interpretations or clarifications considered necessary by Owner in response to such questions will be issued by Addenda delivered to all Owner-registered plan holders. Questions received less than seven days prior to the date for opening of Bids may not be answered. Only responses set forth in an Addendum will be binding. Oral and other interpretations or clarifications will be without legal effect. Responses to questions are not part of the Contract Documents unless set forth in an Addendum that expressly modifies or supplements the Contract Documents. All Addenda shall become part of the Bidding and Contract Documents. The Work will be substantially complete on or before August 15, 2025, and completed and ready for final payment in accordance with Article 15.06 of the General Conditions on or before September 26, 2025. Liquidated Damages Contractor and Owner recognize that time is of the essence as stated in Article 2.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the Contract Times specified above, plus any changes therein allowed in accordance with Article 4 of the General Conditions. The parties also recognize the delays, expense, and difficulties or impossibility involved in proving, in a legal proceeding, the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): A. Substantial Completion: Contractor shall pay Owner $400.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified in Article 2.02 for Substantial Completion, until the Work is substantially complete in accordance with the Contract Documents. B. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the time specified in Article 2.02 (as such Contract Time may be duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $200.00 for each day that expires after the time specified in Article 2.02 until the Work is completed and ready for final payment. C. Milestones: Contractor shall pay Owner $200.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified above for achievement of the Milestone(s), until the Milestone(s) is/are achieved. Bids must be accompanied by Bid security in an amount of five percent (5%) of Bidder's Bid price, and in the form of a Bid bond in a form and from a Surety in a form acceptable to the Authority, to the favor of the Authority, or a certified check made payable to the Monroe County Water Authority. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner may consider any Bid not prepared and submitted in accordance with the provisions herein nonresponsive. Owner also reserves the right to waive all minor Bid informalities. The Authority reserves the right to reject any and all Bids.
