Question Deadline 06/28/2024 at 5:00 PM ET Questions Regarding the Original Solicitation Must Be Submitted to Be Considered for an Addendum. All Questions Received by the Question Deadline Will Be Responded online and Posted for All Bidders. The System Will Not Accept Any Questions After This Date and Time. All communications relating to this solicitation must be submitted online. If any questions or responses require revisions to this solicitation, such revisions will be by formal Addendum only. Bidders are cautioned not to rely on any written, electronic, or oral representations made by any County representative or other person, including the County's technical contact, that appear to change any portion of the solicitation unless the change is ratified by a written Addendum to this solicitation issued by the Office of the Purchasing Agent. Time is of the essence under this Contract. Each Task Order must be completed within the Time for Completion. The County and the Contractor agree that damages for failure to achieve Final Completion of a Task by the date specified under Time for Completion are not susceptible to exact determination but that $1,500.00 per calendar day is in proportion to the actual loss that the County would suffer from such delay. Therefore, the Contractor will pay the County as liquidated damages $1,500.00 per day for each and every day beyond the time for Final Completion that the County determines Final Completion of a Task has not achieved. The County will be entitled to deduct liquidated damages against any sums owed by the County to the Contractor under this Contract. The Contractor hereby waives any defense as to the validity of any liquidated damages on grounds that such liquidated damages are void as penalties or are not reasonably related to actual damages.
