Pedestrian signal modifications and ADA ramps at the intersection of Wolfs Lane and Sparks Avenue. Bid security equal to 10 percent of the bid price is required. Bid security may be in the form of a bid bond, certified check or other guaranteed negotiable instrument, or letter of credit. The bid security of the bidders submitting the three lowest bids will be retained until execution of the contract or a maximum of 180 calendar days after bid opening, whichever is sooner. Bid security of the remaining bidders will be returned within 10 calendar days after the bid opening date. In the event of neglect or refusal on the part of the successful bidder to execute the contract and furnish evidence of insurances within 10 days after written notification of notice of intent to award the contract, and furnish the performance security and labor and material payment bond within three days after receipt of the executed contract, the entire bid security shall be forfeited to and retained by the authority as liquidated damages for such neglect or refusal. The work under this contract shall be completed within ninety (90) calendar days after signing of the contract unless the Village waives adherence to this date in writing. The Contractor will be required to pay as liquidated damages, the sum of five hundred dollars ($500.00) for each calendar day beyond said time that is required to satisfactorily complete the work of this project, except that reasonable time extensions will be granted for any delays resulting from procuring materials including, but not limited to, the pedestrian signals. The Performance Bond that the Contractor is to provide, shall be issued by a solvent insurance company authorized to do business in the State of New York and which will indemnify and insure the Village of Pelham, New York, so that all work herein required to be performed and all material to be furnished, will be satisfactorily completed in accordance with this proposal. The amount of the bond shall be 100% of the amount of the contract price. The Contractor shall also pay for and furnish a separate Labor and Material Bond payment, guaranteeing prompt payment of monies due to all persons supplying the Contractor or any Subcontractor with work, labor or materials employed and used in carrying out the Contract. The amount of such bond shall be 100% of the amount of the contract price. The form of this bond is included herein. In addition, at the time of final payment, a Maintenance Bond guaranteeing against defective materials and workmanship will be required in an amount equal to one hundred percent (100%) of the contract amount. The Maintenance Bond shall be in effect for a period of two years from the date of final acceptance of the project. The Village reserves the right to accept or reject any or all bids and to waive any informalities at its discretion, and to award contracts in a manner deemed to be in the best interests of the Village of Pelham even if such award is to other than the lowest bidder.
