The City of Bismarck (City) Public Works Service Operations is seeking cost proposals for the Collection of the City's Recyclable Material listed as follows: Proposal A - Good Iron Proposal B - White Goods & Scrap Metals Proposal C - Clean Aluminum Signs Proposal D - Non-PCB Ballasts Term of Agreement: The initial term of this agreement shall be for one (1) year and shall automatically renew for three (3) additional one-year periods. Agreement may be extended for an additional two (2) year period upon written mutual agreement of both parties to negotiate in good faith to establish rates. Bids must be submitted on blanks furnished by the City of Bismarck and in accordance with specifications and conditions contained therein. The City, in its sole discretion, may extend the work completion deadline due to unforeseen circumstances, if it is determined to be in the best interest of the City to do so. The City shall reserve the right to hold all bids for a period of sixty (60) days, to reject any and all bids, to waive irregularities or to accept such as may be determined to be for the best interest of the City of Bismarck. However, bids which do not comply with mandatory requirements imposed by law or late bids must be rejected. The Company agrees to remove recyclable material (Proposals A, B, C & D) from the City of Bismarck Municipal Landfill on a quarterly basis. The Company must furnish any and/or all equipment necessary for the removal of recyclable material (Proposal A, B, C & D) from the landfill. This bid price also includes recyclable material acquired during the Spring and Fall Clean-Up weeks and generated by the City shop and other City departments delivered to the Company's site and/or the City Landfill. Each bidder is required to bid on all proposals. Bid will be awarded based on best overall price. The City reserves the right to waive any and all formalities and accept or reject any or all proposals. The initial term of this agreement shall be for one (1) year commencing on bid award date and expiring June 30, 2025. The agreement shall automatically renew for three (3) additional oneyear periods, beginning July 1 of each option year, unless otherwise notified. The agreement may be extended for an additional two (2) year period upon written mutual agreement of both parties to negotiate in good faith to establish rates for calendar years beginning 7/1/2028. Either party may cancel this agreement any time it may be determined to be in the best interest to do so. A notice of intent shall be served at least thirty (30) days prior to the date of said notice of cancellation.
