Disclaimer: To be eligible, contractors MUST purchase plans directly from Colliers Engineering & Design 10 percent SED utilization," "10 percent goal" and "10 percent" means SED business concern participation, which includes 7 percent for minority-owned SED business concerns and 3 percent for women-owned SED business concerns. The project consists of but is not limited to the following: o Establishing traffic control, including coordination with the Burlington County and Bordentown City Police Departments; o Heavy cleaning of sanitary sewer pipe, force main, and structures to be rehabilitated; o Establishing a bypass system, where necessary; o Rehabilitation of sanitary sewer and related structures including manholes and laterals via CIPP lining, ensuring the pipes and structures are debris/obstruction free throughout the installation process; o Installation of new sanitary cleanouts, inlet filters, and one manhole; o Infiltration control and invert repair/patching via geopolymer rehabilitation; o Spot repairs as directed; o Reinstating all sewer laterals where applicable; o Testing of rehabilitated sewer, and; o CCTV of the pipes before and after lining installation is complete. The Borough of Fieldsboro conducts limited business hours. Call ahead to confirm hours of operation (609) 298-6344 x 100. The Contractor is solely responsible for timely delivery of his bid package. The Borough of Fieldsboro awards contracts without using a fair and open process (a non-fair and open process). The law requires that for a non-fair and open contract to be awarded, the contractor may not have made a "reportable contribution" in the previous year; the contractor may not make a reportable contribution during the term of the contract; and pursuant to N.J.S.A. 19:44A-20.8, the contractor must certify that no reportable contributions were made during the one year preceding the award of the contract. All work on this contract, including punch list work, shall be completed within ninety (90) calendar days of notice to proceed which could be issued as soon as September 2024. Work shall consist of all necessary labor, materials and permits to complete: cleanout installation, sewer main lining, force main lining, sewer lateral lining, manhole rehabilitation, restoration, and other miscellaneous related work to complete the project. The contractor must be prepared to begin work immediately following the Notice to Proceed. Bids must be accompanied by a certificate from a surety company stating that it will provide the specified performance and maintenance bonds in the event that the contract is awarded to the bidder. Each bid must be accompanied by a certified check, cashier's check, or bid bond for ten percent of the amount of the bid, not to exceed $20,000, drawn upon an incorporated bank or trust company, payable to the Borough of Fieldsboro as guarantee that in case the contract is awarded the bidder, he will, within ten days thereafter execute such contract and furnish satisfactory performance bond. Upon failure to do so, he shall forfeit the deposit as a partial satisfaction of liquidated damages and the acceptance of the bid will be contingent upon fulfillment of this requirement by the bidder. The checks of all bidders will be returned according to law. No interest shall be allowed upon any such check. The award of the Contract for this project will not be made until the necessary funds have been provided by the Borough of Fieldsboro in a lawful manner. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. All applicable surety bonds required in connection with the advertisement and award of building contracts or sub agreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570--Surety Companies Acceptable on Federal Bonds), incorporated herein by reference. Copies of this document may be obtained from the Department. The Borough or the Engineer reserves the right to require a complete financial and experience statement from prospective bidders showing that they have satisfactorily completed work of the nature required before furnishing proposal forms or specifications, or before awarding the Contract. The Mayor and Council reserve the right to reject any and all bids, or to waive informality of any bid. Proposals for this Contract will only be accepted from bidders who have properly qualified in accordance with the requirements of the Contract documents. The right is also reserved to reject any or all bids or to waive any informalities where such informality is not detrimental to the best interest of the Borough, except as to those items which are deemed mandatory and non-waivable set forth in N.J.S.A. 40A:11-23.2. The right is also reserved to increase or decrease the quantities specified in the manner designated in the Specifications. Further, the Borough reserves the right to abandon the project and reject the bids entirely if any legal or state or federal administrative action is taken against the Borough which could delay or jeopardize the project from commencing. The successful bidder shall be required to comply with all applicable statutory and regulatory requirements, which include but are not limited to the affirmative action requirements of P.L. 1975, c. 127, N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27-1 et seq. This contract or subcontract is expected to be funded by in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Infrastructure Bank. Neither the State of New Jersey, the New Jersey Infrastructure Bank nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9. N.J.A.C. 7:22-3.17(a)24, 4.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be established for the award of contracts to small business concerns owned and controlled by one or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of all contracts for building, materials and equipment, or services (including planning, design and building related activities) for a construction project. The project sponsor has identified that the SED utilization goal for this project is 10 percent. Awards will be made only to socially and economically disadvantaged business concerns that are certified by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies deemed appropriate by the Office as eligible minority businesses or female businesses. The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization requirements. The successful bidder shall be required to comply with the following: A. Affirmative Action requirements (P.L. 1975, C.127, N.J.S.A. 10:5-1 et seq.). B. The provisions of the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25 et seq.). C. Anti-Kickback Regulations under Section 2 of the Act of June 13, 1934, known as the Copeland Act. D. Worker and Community Right-to-Know Act (N.J.A.A. 34:5A-1). E. The American with Disabilities Act of 1990 (ADA) Moreover, the bid must be accompanied by a list of names and addresses of all stockholders owning 10% or more of the stock in accordance with the provisions of the Public Disclosure Law (P.L. 1988, C.33, N.J.S.A. 52:25-24.2).
