Site work, paving and renovation of a mixed-use development in Ocala, Florida. Completed plans call for the renovation of a municipal facility; for site work for a road / highway; and for paving for a road / highway.
You are invited to bid on the scope of work within your area of expertise. Dinkins Construction LLC is one of the Construction Managers for Marion County and has been assigned to the oversight and management of the MCSO Martel Phase 2 Driving Pad Project. This project consists of the construction of a 400' by 800' driving pad with multiple access roads and intersections for emergency vehicle operator training. Bid security is not required; however, the subcontractor must honor the proposal for up to 90 days. Subcontractors must include an alternate to provide a payment and performance bond for 100% of the base bid amount. It is at MC & CM discretion to require or not. The subcontractor acknowledges the penalty clause and accepts the delay penalty for each day that the project runs over the expected completion date at a rate of $500/CALENDAR DAY. . Expected Project Commencement Date is: January 2025 Expected Project Completion Date is: May 2025 Subcontractor includes all work complete and in accordance with the Contract Documents, as defined in the Subcontract Agreement, including but not limited to all attachments, plans and specs. The parties agree that the terms and conditions of the Subcontract take precedence over and control any conflicting terms in the Subcontractor's proposal or bid form attached hereto. 2. Subcontractor includes all labor, materials, equipment, tools, hoisting, machinery, insurance, taxes, fees, licenses, permits, layout, field measurements, OSHA safety regulation compliance, samples, warranties, guarantees, lien releases and claim waivers, temporary facilities, transportation, scaffolding, clean-up, and services necessary to prosecute and complete Subcontractor's Work, and being a portion of the work required of Contractor under the agreement between Contractor and Owner. This shall include but may not be limited to competent supervision, shop drawings, samples, site inspections or verifications, testing, material orders, submission of as-builts, and all other items required for a complete job and to conform to the schedule of work. 3. Subcontractor shall perform the work in strict accordance with the Schedule dated T.B.D. Subcontractor specifically acknowledges and agrees the duration times for Subcontractor's work are adequate for and include completion of all punch list requirements for Subcontractor's work includes all necessary costs required to achieve completion within the time listed. Notwithstanding any language to the contrary in the Contract documents, time shall be counted in workdays and not calendar days. All schedule times are in workdays. A workday defined is a non-holiday workday from Monday through Friday. TIME IS OF THE ESSENCE. Performance start times and durations may be changed by Contractor from time to time as Contractor determines necessary. Subcontractor understands and agrees Contractor may modify the Schedule by one or more of the following methods of notice to Subcontractor; issuance of an updated schedule, by letter, by memo, or at a job meeting and/or job meeting minutes. 4. Subcontractor is to maintain daily redline "As-Built" Drawings for all work and to turnover to Contractor in an acceptable condition at the completion of Subcontractor's work or as otherwise required by Contractor. Failure to maintain daily "As-Built" Drawings acceptable to Contractor shall be basis for Contractor to withhold payment. 5. Subcontractor shall notify Contractor (Project Manager and Superintendent) in writing, of any changed or unknown conditions prior to proceeding with the work or when discovered. 6. If applicable to Subcontractor's work, Subcontractor shall be responsible for submitting complete Shop Drawings digitally, or at contractor's instructions, a minimum of six (6) copies each for shop drawings, equipment specifications, samples, etc., to be in Contractor's hands before T.B.D. Subcontractor shall commence no work without first having in its possession fully stamped and approved Shop Drawings and/or Submittals. Subcontractor is solely responsible for its completed work to be in full compliance with the Contract Documents, approved Shop Drawings/Submittals and/or Change Orders as authorized by Contractor in writing. Subcontractor shall be solely responsible for submitting and obtaining written approval from the project design Architect and Engineer (through the Contractor) for every type of equipment, material, component, and layout used in the work. 7. Subcontractor shall at all times adequately staff the project with skilled workmen under the fulltime supervision of either a qualified foreman or superintendent. 8. Subcontractor includes protection of all stored materials and safeguards necessary to insure adequate protection to the satisfaction of the Contractor and Owner. Contractor will not reimburse Subcontractor for materials that are misplaced, damaged or stolen. 9. Subcontractor represents to be completely familiar with governing codes applicable to the work and includes work performance in full compliance with all applicable governing agencies, current OSHA safety regulations, building and fire code regulations, etc., whether or not specifically identified in the Contract Documents. Should any conflict exist between the Contract Documents and governing codes, the codes will govern. 10. Subcontractor is solely responsible for its subcontractors and sub-subcontractors' compliance in every respect with all governing and regulatory agency requirements, etc., specifically including, but not limited to, Workers' Compensation insurance for all employees and workmen, including all changes to existing law effective as of the date of this Subcontract. 11. Subcontractor is to broom clean up all trash and debris caused by Subcontractor on a DAILY BASIS from the inside of the buildings and site and place all trash in dumpsters provided by Contractor. All boxes and containers shall be flattened or compressed prior to placing in dumpsters. Subcontractor to provide clean-up crews to work in "composite crews" of other Subcontractors for building and site clean-up when directed by Contractor when debris accumulation becomes mixed with that of other trades. Failure of Subcontractor to clean up as required by Contractor will result in Contractor performing Subcontractor's clean up duties and charging Subcontractor $35.00 per hour per man, plus $75.00 per hour for supervision, plus equipment costs. Subcontractor acknowledges any clean up action required by Contractor of its work is a major disruption and nuisance to Contractor's regularly scheduled duties and such costs are fair and reasonable. 12. Subcontractor's jobsite supervisor shall submit Daily Reports (including manpower) to Contractor each day on separate forms provided by Contractor. Failure to provide these forms will be sufficient cause for Contractor to withhold payment until such forms are brought current. This Subcontractor shall attend weekly job progress meetings as requested by Contractor for purposes of establishing short-term schedules. The Subcontractor's Site Representative (Foreman) shall be required to attend these meetings and at the Contractor's discretion, the person who signs this Subcontract Agreement. Subcontractor is to be notified at least 48 hours prior to job progress meeting. 13. Subcontractor includes a standard one (1) year warranty on all work under the Contract Documents from the date of Substantial Completion of the entire project and also specifically includes any other extended warranties that are normally associated with Subcontractor's work and those that are specifically required by the Contract Documents. 14. Prior to starting any field work the Subcontractor shall participate in a Subcontractor's work preparatory meeting with the Contractor at the jobsite to thoroughly review: the work; the schedule; understanding and possession of correct Drawings and Specifications; MSDS Sheets; OSHA Review; approved Shop Drawings and Submittals; required material installation procedures; and payment procedures. Subcontractor is solely responsible for its work being in full compliance with the Subcontract Agreement. 15. Subcontractor may only perform work during specific authorized working hours as authored in writing by Contractor. Under no circumstances is Subcontractor to perform any work or otherwise have any work crews present on the jobsite without the Contractor having authorized the work in advance. 16. The Subcontractor agrees to furnish additional jobsite supervision, including but not limited to the Subcontractors Principal or approved other designate, for a minimum of four (4) hours per day if Contractor so orders.
