Sealed Bids are invited and will be received by the Town of Tyre ("Municipality" or "Town") for the collection, removal and disposal of combined refuse and bulk waste. The contract documents and bid requires the successful bidder, in compliance with the New York State Solid Waste Management Plan, as amended, to dispose of the Municipality's refuse at a facility which is in conformance with the Seneca County Solid Waste Management Plan. Bids must be made on Bid Form and in accordance with the Instructions to Bidders. Award of the bid will be announced at the August 28, 2024 regularly scheduled Town Board meeting. Bid security in the form of a Bid Bond, or a certified or cashier's check payable to the Town of Tyre in an amount equal to ten (10%) percent of the first twelve months of the bid amount must accompany the Bid, in accordance with the Instructions to Bidders. The Municipality will award a contract or reject bids within 45 days from the date the Bids are opened. All Bids and Bid Bonds submitted shall remain valid for a period of 45 days from the date the Bid is opened. However, should there be a referendum the bidder shall hold their bid open long enough for the Town to comply with the permissive referendum requirements, including the possibility that a petition is filed and an election has to be held, such election would have to be held no more than 75 days after the filing of the petition and no less than 60 days after. The issuance of this Solicitation constitutes only an invitation to submit a responsive bid to the Municipality. Notwithstanding any other provision of this Solicitation, the Municipality reserves the right to determine in its sole discretion, whether any aspect of a Bid satisfactorily meets the criteria established in this Solicitation, to waive any informalities or irregularities in any Bid, to reject any or all proposals with or without cause, and to take any other action which the Municipality deems appropriate. The Municipality intends to select the Bidder which, in the sole opinion of the Municipality, presents the lowest, responsive, responsible Bid which best serves the interests of the Town of Tyre. This Solicitation consists of the Invitation to Bid, Instructions to Bidders, Bid Form, Bidder's Affidavit, Affidavit of Non-collusion, Qualification Questionnaire, Bid Bond, Performance Bond, Contract and Specifications. Terms which are defined in the Contract shall have the same meaning when used in the other documents which comprise this Solicitation. The procedures set forth in this Solicitation are for the convenience of the Municipality and shall not give rise to any rights of any person or entity. In the event that a contract is not awarded for any reason, or in the event that this Solicitation is withdrawn for any reason, the Municipality shall have no liability to any person or entity for any costs or expenses incurred in connection with this Solicitation, the Bids or the transactions contemplated by this Solicitation or otherwise. If the Municipality awards the Contract, it shall consist of the above documents and the following additional documents: *Contract *Performance Bond (hereinafter collectively the "Contract Documents"). By submitting a Bid, Bidders agree to be legally bound by all of the terms, conditions and provisions of the Contract Documents, and to perform the services or work for which the Bidder is awarded the Contract. By submitting a Bid, a Bidder warrants that the Bidder: (a) Has had an opportunity to inspect the sites at which the Work will be performed, and the conditions under which the Work will be performed; and (b) Has not discovered any ambiguities or discrepancies in the work description, specification, or other terms or conditions of the Contract Documents, and all addenda thereto; and The successful Bidder will be required to abide by all federal, state and local laws, ordinances, rules and regulations.
