Each sealed Bid and proposal must contain the name and address of every person, firm, or corporation interested in same and shall be accompanied by a Bid guaranty bond, or a certified check or cashier's check in the amount of $6,000, made payable to the City of Louisville, as a guarantee that if the Bid is accepted, a Contract pursuant thereto will be entered into and its performance properly secured. The check of the successful Bidder will be returned upon property execution and securing of the Contract. The check of the unsuccessful Bidders will be returned after a Contract has been awarded and entered, or upon rejection of all Bids The successful Bidder shall furnish a performance bond in the amount of 100% of the Bid price to provide services to residential customers for one year All Bidders and subcontractors will, to the extent practicable, use Ohio products, material, services, and labor. Bidder compliance with the equal employment opportunity requirements of the Title VI of the Civil Rights Act of 1963, Executive Order 11246, dated April 24,1965, Executive Order 11375, dated October 13, 1969, and Section 125.111 of the Ohio Revised Code, effective April 24, 2008. The City of Louisville reserves the right to accept the lowest and/or best Bid, to award or reject sections separately, to delete certain items within any section, to increase or decrease quantities, to waive any informalities or irregularities, and/or to reject all Bids within sixty (60) days after receipt and opening of the Bids. The failure to award a Contract by ordinance within sixty (60) days after Bid opening shall operate as a rejection of all Bids, unless the time for awarding a Contract is extended by mutual consent of the successful Bidder and the City. Section 9.24 of the Ohio Revised Code prohibits the City of Louisville from awarding a Contract to any party against whom an unresolved finding for recovery has been issued by the Auditor of State. The City Manager reserves the right to reject any Bid or any part or parts thereof and to waive any informality therein.
