The undersigned Bidder offers and agrees, if this Bid is accepted, to enter into an Agreement with OWNER in the form included in the Contract Documents to complete all Work as specified or indicated in the Contract Documents for the Contract Price and within the Contract Time indicated in this Bid and in accordance with the Contract Documents. In submitting this Bid, Bidder represents, as more fully set forth in the Agreement, that he has examined the Instructions to Bidders, all of the other Bidding Documents and all of the Contract Documents; that he has examined the actual site and locality where the Work is to be performed; that he has familiarized himself with the legal requirements (federal, state and local laws, ordinances, rules and regulations); that he has made such independent investigations as he deems necessary; and that he has satisfied himself as to all conditions affecting cost, progress, or performance of the Work; and that by signing this bid waives all rights to plead any misunderstanding regarding the same. Bidder declares that no person or persons other than those named herein are interested in this Bid; that this Bid is made without collusion with any other person, firm or corporation; and that no person or persons acting in any official capacity for the OWNER are directly or indirectly interested in this Bid, or in any portion. of the profit thereof. The undersigned further understands and agrees that the estimated quantities for the unit bid price Items are unpredictable and the OWNER has inserted certain quantities in the proposal to be used solely for purpose of comparison of bids. The OWNER does not expressly or by implication agree that the actual quantities will correspond therewith and reserves the right to increase or decrease any quantity or to eliminate any quantity, as he may deem necessary. The Bidder will not be entitled to any adjustment in the unit price bid as a result of changes in any of these quantities ranging from zero to any quantity. The Bidder shall make no claims for anticipated profits, for loss of profits, or for other damages as the result of changes in the quantities of unit price items purchased. Unless otherwise stated, the OWNER shall supply all street light fixtures, arms and poles. The Bidder is referred to the Supplementary Conditions and sections 01010 and 01020 of these Contract Documents for Bidder's responsibilities specific to each item and as to what is included. M/L Material Et Labor. The OWNER is requesting bids for a two (2) year period as follows: YEAR 1 2024 Contract Period - October 1, 2024 to December 31, 2025 (Base Bid) YEAR 2 2025 Contract Period January 1, 2026 to December 31, 2026 (Alternate Bid) Bidder further agrees as follows: 1. That this Bid shall remain open and may not be withdrawn for the time period set forth in the Instructions to Bidders. 2. That he accepts all of the terms and conditions of the instructions to Bidders, including without limitation those dealing with the disposition of his bid security. 3. That OWNER has the right to delete bid items and/or bid sections prior to or after award if OWNER deems this to be in OWNER's best interest. 4. That in the event an item is deleted in its entirety, no payment shall be made under the item and no adjustment in the unit price for the item is necessary. 5. That upon acceptance of this Bid, he will execute the Agreement and will furnish the required contract security and insurance certificates within the time period(s) set forth in the Instructions to Bidders. 6. To be available to work within five (5) calendar days from the date of "Notice to Proceed" as outlined in the Contract Documents. 7. Bidder shall comply with all applicable ordinances, laws, rules, regulations and prevailing wage rates. Note: CONTRACTOR shall write-in UNIT PRICE and ITEM COST for each item in base bid. If bidding the alternate bid, CONTRACTOR shall write-in UNIT PRICE and ITEM COST for each item in alternate bid. Any Item base bid incomplete, unbalanced or disproportionate to its degree of difficulty shall be considered sufficient grounds to dismiss the bid. Location Townwide - Amherst, New York The OWNER reserves the right to award the Base Bid only. In the event that the CONTRACTOR for the Base Bid (Year 1) is also the low bidder for the Alternate Bid (Year 2), then the OWNER reserves the right to award the Alternate Bid at any time prior to the end of the Base Bid Contract Period at no increase in the Alternate Bid Contract Price. In addition, OWNER reserves the right to reject the Alternate Bid at the time of award of the Base Bid. Bidders must bid all items in each year and only Bidders bidding on the first year will be accepted as eligible for the second year. If the Bidder chooses only to bid the first year, it is requested that they so indicate their non-interest in the second year by marking each bid item of the second year with "N/A". The normal working hours for any priority work orders performed under this Contract shall be Monday to Friday, 8:00 4:00P.M. Failure to provide the necessary daily work crew(s) will result in liquidated damages as outlined in article 5 of the agreement.
