The Town of Nantucket, through its Natural Resources Department, seeks qualified bidders offering excavation services for the seasonal pond openings at Hummock Pond and Sesachacha Pond on Nantucket Island. The Town of Nantucket is located 30 miles off the south coast of Cape Cod. It was settled in 1659 and incorporated in 1671. The Town has an annual year-round population of over 14,000 and approximately 60,000 seasonal residents. The island is 14 miles in length and 3 1/2 miles wide. The Town of Nantucket is within the County of Nantucket. It operates an operated skilled nursing facility, an extensive Public School System and other municipal operations. The Town functions under a Town Manager/Select Board form of government. The Select Board operates under a Charter and enacts policies intended to promote and enhance the general welfare of the Town. Question Submission Deadline: September 20, 2024, 2:00pm Question Response Deadline: September 26, 2024, 2:00pm The successful Contractor will meet with the Town's Water Quality Specialist to determine an appropriate but feasible amount of time to maintain the pond opening or establish a minimum goal for number of tidal flushes based on current nitrogen loads, salinity, and residence times. The Water Quality Specialist will use the best available information to advise the Contractor on the minimal amount of time to excavate an opening for each body of water. Prior work and modelling have been performed to make general recommendations for optimal opening times based on nitrogen data, salinity, and residence times for each body of water. These documents along with current water quality data can serve to guide opening duration goals for this contract. Hummock Pond Estuary Plan (2014) listed residence times of ponds and suggested flushing time in days. Adjustments may need to be considered based on current nutrient loads reported for the year. Sesachacha Pond Estuary Plan (2006) listed residence times of pond and suggested flushing time in days. Adjustments may need to be considered based on current nutrient loads reported for the year. Poor references may be a basis for determining that a bidder is not responsible. Reference questions will include but may not be limited to work quality, customer service, and general customer satisfaction. Pursuant to Massachusetts General Laws, chapter 149, sections 26 and 27, the Division of Occupational Safety (formerly the Department of Labor and Industries) has determined the Prevailing Wage Rates for this work. The enclosed rates apply only to this work. The Prevailing Wage shall become part of the contract signed between the successful bidder and the awarding authority or the contract is invalid. Prevailing Wages must be paid to all persons employed on the public works project, regardless of whether they are employed by the successful bidder or a subcontractor. The wage rates issued for each project shall be paid for the entire project. Payroll records must be kept by the successful bidder for all persons employed on the project. A separate Statement of Compliance must be submitted to the Division of Occupational Safety by every employer, including all prime contractors and subcontractors, when its portion of the work is completed. The enclosed form entitled "Weekly Payroll Records Report and Statement of Compliance" clearly details these requirements. A certified payroll must be submitted to the Board of Selectmen office for each week work is performed for the Town under this contract. That they are able to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the work; and Who shall certify that all employees to be employed at the worksite will have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration at the time the employee begins work and who shall furnish documentation of successful completion of said course with the first certified payroll report for each employee; and That all employees to be employed in the work subject to this bid have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration. Any employee found on a worksite subject to this section without documentation of successful completion of a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration shall be subject to immediate removal. SECTION 5 This act shall take effect on July 1, 2006 Bidders should note that per MA State Mandate, the Town of Nantucket does not pay deposits or any form of pre-payment in order for work to begin. When submitting quotes, it is understood that the Town of Nantucket reserves the right to reject any, and all quotes, or parts of any quote. The Successful Bidder must furnish a Payment Bond in amount at least equal to fifty percent (50%) of the contract price with a surety company acceptable to the Town of Nantucket. This successful bidder shall perform services as necessary from October 15, 2024, to October 14, 2027. This is intended to be a three (3) year contract.
