The Project generally involves the removal of 150 linear feet of existing corroded unlined cast iron pipe (CIP) and subsequent replacement with epoxy lined ductile iron pipe (DIP). This project also includes 920 linear feet of cured-in-place liner (CIPP) in existing 6-inch sanitary sewer pipe, the raising of existing buried manholes, and the evaluation, repair, and reconnection of sanitary sewer service laterals. Bidder's attention is directed to those provisions of the Specifications which require the contractor to whom the contract for the work is awarded, to file with the City Clerk at the time the contract is executed, a Contractor's Payment Bond and a Bond for Faithful Performance meeting all the requirements of the Specifications and approved by the City Attorney of the City of San Jose. Bonds must be issued by a surety that is an "admitted surety insurer" in the State of California possessing a power of attorney and shall name the City of San Jose as beneficiary. The Contractor's Faithful Performance Bond shall be for 100% of the contract amount. The Contractor's Payment Bond shall be for 100% of the contract amount. Each bid must be accompanied by an electronic pdf copy of a bidder's bond in the sum of not less than 10% of the total aggregate amount of the bid. Bonds must be issued by a surety that is an "admitted surety insurer" in the State of California and must name the City of San Jose as beneficiary. Bonds must be accompanied by an electronic pdf copy of the surety's power of attorney and a notary acknowledgement for the surety's signature. Bidders must retain the original wet-signed bidder's bond and provide it to the City upon request. This project is a Minor Public Work being procured in accordance with San Jose City Charter Section 1217(d) and San Jose Municipal Code Section 27.06.050. As such, the following provisions apply: The contract for this project can only be awarded if the lowest responsive and responsible bid is less than $740,000. If that threshold is exceeded, the City will reject all bids and decide whether to re-bid the project. The Local and Small Business Preference requirements of Chapter 4.12 of the San Jose Municipal Code apply to this procurement. In order for a contractor to be a Local Business Enterprise (LBE) the contractor must have a current San Jose Business Tax Certificate Number and have an office located in Santa Clara County with at least one employee. If a contractor qualifies as an LBE the contractor can also qualify as a Small Business Enterprise (SBE) if the total number of employees (regardless of where they are located) of the firm is 35 or fewer. The right to protest is not applicable to this procurement. Bidders must submit questions or requests for information concerning any part of this bid in writing to the City via Biddingo. The City will not respond to any communication or question submitted directly to City staff or City consultants. Submit questions via Biddingo no later than Thursday, October 17, 2024 at 11:00 am. The project must have involved the same elements of construction using similar construction trades as this Project; and b) In total, the projects must have involved at least 5,000 linear feet of sanitary sewer and/or storm drain Cured-In-Place Pipe installation. Every request for interpretation should be submitted through the City's online solicitation webpage, and to be given consideration, must be received no later than the request for information deadline set forth in the Notice to Contractors. Any and all interpretations will be in the form of writing which, if issued, will be available to all prospective bidders prior to the opening of bids through the City's online solicitation webpage. Failure of any bidder to receive any interpretation shall not relieve the bidder from any obligation under their bid as submitted and the bidder shall be required to perform the work as modified by the interpretation. All interpretations issued, shall become part of the contract.
