sealed bids will be received by the Millburn Board of Education ("Board"), Essex County, New Jersey for the HVAC Upgrades at Washington Elementary School ("Project"). HVAC Upgrades at Washington Elementary School PSA The scope of the project includes, but is not limited to, the replacement of two (2) existingair handling units, one (1) roof top unit, associated ACCU's, controls and any roof, concrete pad, and ductwork modifications required to accept new units. Bidders must email their request at least twenty-four (24) hours or one (1) business day in advance to gain access to bid documents as a registered plan holder. Project information is also available on the Architect's website . Any bid submitted by mail or delivery service is done so at the sole risk of the Bidder. No bids will be received by facsimile or electronic transmission. It is expressly understood that the Bidder is responsible for getting the bid proposals to the Business Administrator prior to the time and date set for the bid opening. Any bid received after the bid submission time deadline will be returned unopened. In order to be considered, bids must be sealed and outer envelope clearly marked: HVAC Upgrades at Washington Elementary School Contractors shall be required to abide by any and all Executive Order(s), Rules and Regulations, and both Federal and State Law pertaining to safety precautions required as a result of Coronavirus disease ("COVID"). No modifications to the Instructions to Bidders, General Conditions, Supplemental Conditions or Specifications will be permitted prior to bid acceptance except as may be allowed by amendment as outlined in the Specifications. Bids that propose modifications to the requirements may result in rejection of the bid as being non-responsive. Pursuant to N.J.S.A. 18A:18A-21(c)(2), Addenda, if any, shall be provided no later than seven days, Saturdays, Sundays, or holidays excepted, prior to the date for acceptance of bids, to any person who has submitted a bid or who has received a bid package, by one of the listed means in the law, and additionally as posted to the FTP site containing the bid documents. Questions will be considered only up until the inquiry deadline stated in the Instructions to Bidders. Bids will be considered in accordance with N.J.S.A. 18A:18A-1 et. seq. and N.J.S.A. 18A:7G-1 et. seq. Bids will be received from a Bidder for one price for the entire Project, all trades, all inclusive. Pursuant to N.J.S.A. 18A:18A-27.1, in order to be eligible to submit a Bid for the Project, the Bidder shall be classified by the New Jersey Department of Treasury, Division of Property Management and Construction ("DPMC") as of the date and time of the bid opening in the following disciplines: (C032) HVACR As of the date and the time of the bid opening, the Bidder will either be DPMC classified for or contract with subcontractors that are DPMC classified as the following: (C047) ELECTRICAL (C029) STRUCTURAL STEEL AND ORNAMENTAL IRON Such subcontractors shall be required to be named in the bid, and all documentation for the subcontractors shall be submitted in accordance with the bidding instructions and applicable law. This Project is a school facilities project as defined in the Education Facilities Construction and Financing Act, N.J.S.A. 18A:7G-1 et seq. and will be funded with grant monies from the New Jersey Schools Development Authority ("SDA"). All contractors and subcontractors engaged by the Board to work on this Project shall agree to be bound by the terms of any Grant Agreement entered into between the Board and the SDA, which will be available for review as part of the bidding documents. Bidders and their subcontractors shall be prequalified by the SDA in the same categories as the New Jersey Department of Treasury set forth herein. The successful Bidder shall be required to execute a contract agreeing to be bound by applicable provisions of the Board pursuant to the Educational Facilities Construction and Financing Act, N.J.S.A. 18A:7G-15. Additionally, if the Bidder is not classified by the DPMC for the following classification(s), the Bidder shall be required to retain a subcontractor that is classified by the DPMC as listed to perform such work. The selected subcontractor(s) for the following shall NOT be named in the bid. (C092) ASBESTOS REMOVAL / TREATMENT Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq., and N.J.A.C. 17:27. An Initial Project Workforce Report will be required from the successful Contractor. (Form AA-201). Bidders must comply with all of the requirements of Affirmative Action and the Law Against Discrimination and agree to the Mandatory Equal Opportunity Language to be included in its contract. Statement of Ownership Requirement: Pursuant to N.J.S.A. 52:25-24.2, Bidders shall submit a statement setting forth the names and addresses of all persons and entities that own ten percent or more of its stock or interest of any type at all levels of ownership. Bidders and all subcontractors are required to comply with the Public Works Contractor Registration Act, (N.J.S.A. 34:11-56.48 et seq.) and to possess current certification from the Division of Wage and Hour Compliance in the Department of Labor and Workforce Development at the time the bid is submitted. Bidders and all subcontractors for whom DPMC and SDA prequalification is required are also required to submit a Business Registration Certificate issued by the Division of Revenue in the New Jersey Department of Treasury prior to contract award. All Bidders are required to submit with the bid, an affidavit by the Bidder that the Bidder is not, at the time of the bid, included on the New Jersey State Treasurer's List or the Federal Government List of Debarred, Suspended or Disqualified Firms or individuals pursuant to N.J.S.A. 52:32-44.1, N.J.A.C. 17:19-4 and N.J.A.C. 19:38A-4. Then, prior to contract award, the successful Bidder will be required to submit separate certification that all entities having controlling interest are not on the federal list of debarred contractors. All Bidders are required to complete and submit, prior to contract award, a Disclosure of Investment Activities in Iran Form in accordance with N.J.S.A. 52:32-58 and N.J.S.A. 18A:18A-49.4. All Bidders are also required to complete and submit, prior to contract award, a certification attesting, under penalty of perjury, that neither the person or entity, nor any of its parents, subsidiaries, or affiliates, is identified as a person or entity engaging in prohibited activities in Russia or Belarus as such terms is defined in P.L. 2022.c.3, section1.e, except as permitted by federal law. Bids must be accompanied by bid security in the form of (1) a bid bond or certified or cashier's check payable to "Millburn Board of Education" equal to 10% of the amount of the bid, but in no case to exceed $20,000.00 pursuant to N.J.S.A. 18A:18A-24, and (2) Certificate of Consent of Surety pursuant to N.J.S.A. 18A:18A-25, obligating the issuing surety company to provide the bidder and its subcontractors, if successful, with a New Jersey Statutory Performance Bond and a New Jersey Statutory Payment Bond each in the full amount of the contract. No bid may be withdrawn for a period of sixty (60) days after the opening date. The Millburn Board of Education reserves the right to reject any and all bids, and/or to waive any informality in the bidding, or minor immaterial defects in any bid, as permitted by law, if in the best interest of the Board to do so. The Contract will be awarded to the lowest responsive responsible bidder as defined and provided for in the Public School Contracts Law, N.J.S.A. 18A:18A-1, et seq. Should any error, omissions, inconsistencies, or obscure wording appear or occur in the Drawings and Specifications, or should there be any discrepancies between Drawings and Specifications, the Bidder shall, before submitting its bid, apply to the Architect in writing for an interpretation and determination of the intent of the Drawings and Specifications. Requests received by the Architect after 5:00 P.M. on Thursday October 3,2024, may not be considered.
