A. Notice to Bidders: Qualified Bidders to submit bids for Project as described in this Document and in accordance with the Instructions to Bidders. 1. Regulatory Requirements: The Kentucky Department of Education (hereafter referred to as KDE) is to govern submittal, opening, and award of bids. B. Project Identification: Paris Independent School Athletic Complex Renovation. CMW Project Number: 24024.01. 1. Project Location: 605 Georgetown Road (US-460), Paris, Kentucky 40361. C. Owner: Paris Independent Schools Board of Education. 1. Owner's Representative: Stephen McCauley, Superintendent, 310 West 7thStreet, Paris, Kentucky 40361. D. Architect: CMW, Inc. 249 East Main Street, Lexington, Kentucky 40507. 1. Principal: Brad Boaz, PLA 2. Project Manager: JT Hulan, AIA E. Project Description: Project consists of site improvements to the existing softball, soccer, and baseball fields. Sports Lighting for the existing baseball, softball, and soccer fields. New construction for two elevated press boxes as wood framed construction with a new PA system at the existing Athletic Complex. F. Construction Contract: Bids will be received for the following Work: 1. General contract (all trades). BID SECURITY A. Bid security shall be submitted with each bid in the amount of [5] five percent of the bid amount. No bids may be withdrawn for a period of [30] thirty calendar days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities. TIME OF COMPLETION A. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time. Work is subject to Liquidated Damages. 1. Contract Time: a. 120 Calendar Days from Notice to Proceed to Substantial Completion. b. 135 Calendar Days from Notice to Proceed to Final Completion. c. All Baseball, Softball and Soccer Field Improvements must be completed by March 1, 2025. 2. Liquidated Damages: a. A sum of one hundred fifty dollars ($250.00) per calendar day in which the project does not reach Substantial Completion after the predetermined date of Substantial Completion. b. The sum shall represent the actual damages which the Owner will have sustained per day by failure of the Contractor to complete the work within the time stipulated, and this sum is not a penalty, being the stipulated damage the Owner will have sustained in event of such default by the Contractor. PROJECT TIMELINE A. The successful Bidder to whom the Contract is awarded will be required to execute the Contract and provide Insurance Certificates within fourteen (14) calendar days from the date of the Notice of Award. The Notice of Award will be accompanied by the necessary Contract. WARRANTY A. Neither the final certificate nor payment nor any provisions in the Contract Documents shall relieve the Contractor of responsibility for faulty materials, or workmanship and, unless otherwise specified, he shall remedy any defects due thereto and pay any damage to other work resulting there from, which shall appear within a period of one year from the date of substantial completion of the work. The Owner shall give notice of observed defects with reasonable promptness. B. Defective work, equipment, materials and workmanship that develops within warranty period, which is not caused by ordinary wear, damage or abuse by others, shall be replaced or corrected without additional cost to Owner. BIDDER'S QUALIFICATIONS A. Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder. INSURANCE A. The Contractor will not be permitted to commence work until all insurance required by the documents is obtained and such insurance has been approved by the Owner, nor shall the Contractor allow any Subcontractor to commence work until all insurance required has been obtained and approved.
