The work to be done hereunder includes but may not be limited to: The expansion and restructuring of a current asphalt parking lot, removal and replacement of concrete sidewalk, chain-link fencing, stormwater management, and minor utility work at Berkeley Glenn Elementary School in Waynesboro, Virginia for Waynesboro City, VA Public Schools. All work shall be as indicated on the Contract Documents, and as specified herein. Berkeley Glenn Elementary School Parking Lot Expansion. Bids shall be binding for a period of sixty (60) days from the date on which bids were opened. Bidders are required under Title 54.1, Chapter 11, Code of Virginia (1950), as amended, to be licensed as a "Class A Contractor" before submitting a bid of one hundred twenty thousand ($120,000) dollars or more; or to be licensed as a "Class B Contractor" before submitting a bid of ten thousand ($10,000) dollars or more but less than one hundred twenty thousand ($120,000) dollars; or be licensed as a "Class C Contractor" before submitting a bid of no more than ten thousand dollars ($10,000). Each Bidder will be required to give their State Registration Number on their proposal. All non-resident contractors and subcontractors bidding the work described herein shall register with the Department of Labor and Industry under the provisions of Section 40.1-30 of the Code of Virginia. All bids shall be accompanied by a bid guarantee of not less than 5% of the amount of the bid, which may be a certified check, cashier's check, or bid bond of 5% of the amount of the bid, made payable to the Waynesboro City, VA School Board. For each day after the Contract date for Substantial Completion (each date of Substantial Completion at each School) that the Work is not substantially complete, the Contractor shall pay to the Owner as liquidated damages the amount of $500.00 per calendar day for the Owner's loss of use of the Project and the added administrative expense to the Owner to administer the Project during the period of delay. In addition, the Contractor shall reimburse the Owner for all additional Architect's fees and legal fees incurred by the Owner as a result of the delay. The Owner may deduct any liquidated damages or reimbursable expenses from the money due or to become due to the Contractor. If the amount of liquidated damages and reimbursable expenses exceeds any amounts due to the Contractor, the Contractor shall pay the difference to the Owner within ten (10) days after receipt of a written request from the Owner for payment.
