The City of Fresno hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law. Furthermore, the City of Fresno hereby notifies all Bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, sex, national origin, religion, age, or disability in consideration for an award. The City will carry out applicable federal requirements in the award and administration of any contract awarded hereunder. This is a federal project funded with financial assistance from the U.S. Department of Transportation, Federal Highway Administration (FHWA). Bidders are advised that, as required by federal law, the State of California has established a statewide overall DBE goal. City of Fresno federal-aid contracts are considered to be part of the statewide overall DBE goal and the City is required to report to the California Department of Transportation (Caltrans) on DBE participation for all Federal-aid contracts each year so that attainment efforts may be evaluated. Bidders are advised that, as required by federal law, the City of Fresno is implementing new Disadvantaged Business Enterprise requirements for Disadvantaged Business Enterprises (DBE). DBE goals will be determined for each individual Job Order. DBE participation shall be calculated on the basis of the total cost of the issued Job Order. Liquidated Damages $500.00 per calendar day Project Duration 3 Years + one 2-year extension Bid Bond $25,000.00 Payment Bond 100.00% Performance Bond 100.00% License Requirements No bid will be considered for award unless the Bidder at the time of bid opening, is licensed with a valid Class "A - General Engineering" Contractor's License issued by the State of California. Scope of Services The scope of work includes but is not limited to; A Job Order Contract is an indefinite quantity contract pursuant to which the Contractor may perform an ongoing series of individual Projects at different locations within the City or at any location or facility under the jurisdiction of the City. The bid documents include a Construction Task Catalog containing construction tasks with preset Unit Prices. All Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction. The Contractor will bid four Adjustment Factors to be applied to the Unit Prices. The first will be an Adjustment Factor for performing work during Normal Working Hours, the second Adjustment Factor for performing work during Other Than Normal Working Hours, the third Adjustment Factor will be for performing Federally Funded work during Normal Working Hours, and the fourth Adjustment Factor will be for performing Federally Funded work during Other than Normal Working Hours. When preparing a proposal, the Contractor shall select the appropriate Adjustment Factor. The same four Adjustment Factors shall apply to every Pre-priced Task in the Construction Task Catalog The City may award Contract(s) to the lowest responsive and responsible bidder(s) but reserves the right to reject any and all bids and waive any irregularities in any bid received. Thereafter, as projects are identified the Contractor will jointly scope the work with the City. The City will prepare a Detailed Scope of Work and issue a Request for Proposal to the Contractor. The Contractor will then prepare a Job Order Proposal for the Project including a Job Order Price Proposal, drawings and sketches, a list of subcontractors and materialmen, construction schedule, and other requested documentation. The Job Order Price shall equal the value of the approved Job Order Price Proposal. The value of the Job Order Price Proposal shall be calculated by summing the total of the calculation for each Pre-priced Task (Unit Price x quantity x Adjustment Factor) plus the value of all Non-Pre-priced Tasks. Notes See Bid Specifications for full details. A Job Order will reference the Detailed Scope of Work and set forth the Job Order Completion Time, and the Job Order Price. The Job Order Price shall be a lump sum, fixed price for the completion of the Detailed Scope of Work. A separate Job Order will be issued for each Project. Extra work, credits, and deletions will be contained in a Supplemental Job Order. The Supplemental Job Order will result in the City issuing a Change Order to the existing Contract. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document. Estimated Bid Value min $25,000 max $6,000,000 The work hereunder constitutes a "public work" as defined in Chapter 1, Part 7, Division 2 of the California Labor Code, and Contractor shall cause the work to be performed as a "public work" in accordance with such Chapter of the California Labor Code. The Council of the City of Fresno has adopted Resolution No. 82-297 ascertaining the general prevailing rate of per diem wages and per diem wages for holidays and overtime in the Fresno area for each craft, classification, or type of worker needed in the execution of contracts for the City. A copy of the resolution is on file at the Office of the City Clerk The services of an interpreter and additional accommodation can be made available. Requests for accommodation should be made at least five working days but no later than 48 hours prior to the scheduled meeting/event. In accordance with provisions of section 22300 of the California Public Contract Code, Contractor may substitute securities for any monies withheld by City to ensure performance under the Contract. The Payment and Performance bonds shall be required as part of each Job Order. The Payment and Performance bonds shall be in penal sum equal to the Job Order Price. In the event the parties agree to exercise the option terms the Contractor shall deliver new Payment and Performance Bonds on any outstanding Job Orders. As required on a Job Order by Job Order basis, the Contractor shall provide a payment and performance bond(s) in an amount equal to the Job Order Price. Contractor shall supply such bonds within 7 days after receiving a request for such bonds. The bonds shall be identical in all respects to the form of bonds approved by Owner with no variations, additions, or deletions. The City reserves the right to reject any and all bids.
