Sealed RFB's will be accepted for furnishing the Elburn & Countryside Fire Protection District Station #2 concrete rehab services. The specific listing and work description for the rehab of the concrete at Elburn fire station #2 located at 39W950 Hughes Rd, Elburn, County of Kane, and State of Illinois is available by calling Station #1 (630) 365-6855 or by e-mailing a request to info@elburnfire.gov. A. Instructions to Submitters: The following instructions are to be observed and complied with by all Submitters in preparing an RFB proposal: a. To be considered, all proposals must be made in accordance with this "Instructions to Submitters". NON!COMPLIANCE WITH THESE INSTRUCTIONS WILL BE CAUSE FOR IMMEDIATE REJECTION OF THE RFB PROPOSAL. b. By submitting an RFB, the submitter understands and agrees that, if that proposal is accepted and the submitter fails to enter into a contract with, the submitter shall be liable to the Fire Protection District for any damages the District may suffer. d. RFB to be on the basis of check upon the final completion and acceptance in accordance with the Fire District's specifications. e. No RFB may be withdrawn for a period of sixty (60) days after RFB closing date (October 25th 2024). f. The Fire District reserves the right to reject any and all RFBs and to accept the RFB it feels is in the best interest of the Department. g. RFB's may not be modified after submittal. The submitter may withdraw proposals either personally or by written request at any time before the hour set for the RFB opening, but may not resubmit them. No proposal may be withdrawn or modified after the RFB openings except if the award of contract has been delayed for a period more than forty-five (45) days. B. Submitter Responsibility: a. In addition to complying with the statutes and regulations specifically referenced in this RFB, the submitter is responsible for determining the applicability of and complying with all other laws, regulations, ordinances, etc. which govern the Submitter's performance. All applicable federal, state and local laws, rules and regulations governing the performance required by Submitter shall apply to this RFB specification and will be deemed to be included in this RFB specification the same as though written herein in full. Submitter is responsible for ensuring compliance with all applicable laws, rules and regulations, including, but not limited to, those specifically referenced herein. Except where expressly required by applicable laws and regulations, the Fire Protection District shall not be responsible for monitoring Submitter's compliance. b. State of Illinois Discrimination Laws (775 ILCS 5/1-101 et. seq.). In carrying out the performance required under this RFB specification, and any contract subsequently awarded pursuant to the RFB, the Submitter shall comply with all applicable provisions of the Illinois Human Rights Act, and rules and regulations promulgated by the Illinois Department of Human Rights, prohibiting unlawful discrimination in employment. Submitter's failure to comply with all applicable provisions of the Illinois Human Rights act including specifically provisions related to sexual harassment, or applicable rules and rights promulgated there under, may result in a determination that Submitter is ineligible for future contracts or subcontracts with the Fire Protection District, and any contract awarded may be canceled or voided by the district in whole or in part, and such other sanctions or penalties may be imposed or remedies as provided by statute or regulation. c. Drug-free Workplace Act (30 ILCS 580/1, et. seq.). Submitter must comply with all of the provisions of the Drug-free Workplace Act, which are applicable to the Submitter. False certification or violation of the requirements of the Drug-free Workplace Act may result in sanctions including, but not limited to, termination of this RFB specification and any contract awarded and debarment of contracting or RFB opportunities with the Fire Protection District for at least one (1) year but not more than five (5) years. d. Freedom of Information Act (5 ILCS 140/1 et. seq.). Applications, program reports and other information obtained by the Fire Protection District under this RFB specification shall be subject to the Freedom of Information Act. e. Americans with Disabilities Act. As a condition of receiving this bid, the Submitter certifies that services and activities provided under this RFB specification comply and will continue to comply with The Americans with Disabilities Act (hereinafter "ADA") (42 U.S.C. 12101 et. seq.) and the regulations there under (28 CFR 35 & 36). C. Substitutions and Waivers: a. Certain materials and equipment are specified by a manufacturer or trade name to establish standards or quality and performance and not for the purpose of limiting competition. As such, Submitter's are invited to submit RFB's not only on named items but also on items that they propose for substitution of named items. Products of other manufacturers may be substituted if, in the opinion of the Fire Protection District, they are equal to those specified in quality, performance, design, and suitability for intended use. When two or more items are specified, the selection among those specified is the Contractor's option. b. RFB's shall be based on materials and equipment included in the specifications. Substitutions for the purpose of evaluating RFB's will be considered only if proposed substitutions are set forth in a sealed RFB and will only be accepted prior to the award of contract. The offer of substitutions shall be an integral part of the proposal, appearing immediately after all requested RFB's and before the signature of the Submitter for the entire proposal. c. A waiver of any condition of this bid specification must be requested in writing. No waiver of any condition of this RFB specification is effective unless accepted in writing from the Fire Protection District. d. Assignment. The benefits of this RFB specification and the rights, duties and responsibilities of the Submitter under this RFB specification may not be assigned (in whole or in part) except with the express written approval of the Fire Protection District. Any assignment by the Submitter in violation of this provision renders this RFB specification void and any contract awarded by the Fire Protection District. D. General Construction Scope of Work Bid: a. Remove and replace 99' x 18'-4" at the center section of the pavement area. b. Dowel all new concrete into existing at 18" O.C. c. Sawcut and remove diamonds @ 8 locations where pavement is deteriorated and intersects all joints that adjoin the center section that is being removed. d. All new concrete to be 8" thick with 4x4x4 gauge wire mesh. e. List any additional work not describe here
