The City will award one contractor all projects listed on this announcement in anticipation of a turn-key and timely completion. Bidding documents must be submitted individually for each property, however, one final cost, including all work and costs for all properties, should be totaled and clearly submitted on the provided forms. This project will be funded in whole or in part, with Federal dollars from the U.S. Department of Housing and Urban Development (HUD), Community Development Block Grant Program, (CDBG) administered through the CDBG Department of the City of Conroe, TX. Successful Bidder may be utilized for up to Five (5) years for additional projects related to the Housing Program and neighborhood revitalization. The City of Conroe is an Equal Opportunity Employer. Consideration will be given to all Historically Underutilized Businesses (HUBs). Disadvantaged Business Enterprise (DBE) firms must have appropriate certification and provide the certification at the time of submitting their proposal. Policy - It is the policy of HUD that Disadvantaged Business Enterprises (DBE) have the maximum opportunity to participate in the performance of contracts financed in whole or part with Federal funds. The contractor agrees to ensure that DBE's have the maximum opportunity to participate in the performance of contracts and subcontracts financed in whole or in part with Federal funds. The contractor shall not discriminate on the basis of race, color, national origin, sex, sexual preference, creed, religion, ancestry, disability or other handicap, age, marital/family status with regard to public assistance in award and performance of contracts funded in whole or in part with Federal funds. The City of Conroe seeks and supports Section 3, HUB, and DBE firms and encourages their bid submission. This opportunity is covered under Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u (Section 3). The City of Conroe supports and promotes Equal and Fair Housing. Where applicable the successful contractor must: Comply with Title VI of the Civil Rights Act of 1964 (P.L. 90-352) as amended; Title VIII of the Civil Rights Act of 1968 as amended; the Fair Housing Act (P.L. 90-284); Section 504 of the Rehabilitation Act of 1973; the Americans with Disabilities Act of 1990; The Age Discrimination Act of 1975; Executive Order 11603 as amended by Executive Order 12259; and with Executive Order 11246 as amended by Executive Orders 11375,11478,12806, and 12107; Comply with any Federal Regulations issued pursuant to compliance with Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794), which prohibits discrimination against the handicapped in any Federal funded contract; Comply with Affirmative Action and Executive Order 11246 of September 24, 1965. Compliance with the provisions of Section 3, the regulations set forth in 24 CFR 135, and all applicable rules and orders issued there under; Comply with the Hatch Act; Comply with the provisions of 24 CFR 570.611, relating to Conflicts of Interest; Comply with Texas HB 1295, Section 2252.908; and the filing of Form 1295 Certification located on the Ethics Commission website An original Form 1295 should be notarized and included with the bid response. Ensure compliance with and manage Davis Bacon Act requirements, if, and where applicable, including; throughout the construction phases, such as but not limited to, certified payrolls, etc. Comply with the Copeland Act, Fair Labor Standards and Contract Work, Hours and Safety Standards Act, and Minority/Women Business Entity Priority. The City of Conroe has adopted Fair Housing Policies. Definitions - Disadvantaged Business Enterprises (DBE) means a small business concern: (1) which is at least 51 percent owned by one or more socially and economically disadvantaged individuals, or in the case of any publicly owned business, at least 52 percent of the stock of which is owned by one or more socially and economically disadvantaged individuals; and (2) whose management is daily economically disadvantaged individuals who own it, as certified. Contractors and sub-contractors participating in federally funded programs, such as this project, must not be listed in the Excluded Parties List System as debarred or listed as debarred with the System Award Management System, or other such contractor listing system. Contractors may be required to register with the federal System Award Management System and are required to have a DUNS number. Contractors and sub-contractors must be legitimately operating and insurance will be required, as per the bid documents. The successful proposer will be required to provide a Letter of Credit in the amount of 10% of the total contract price from a Surety Company holding a permit in the State of Texas and approved by the Federal Government, or other approved creditor. No statement may in any way qualify, modify, substitute or change any part of the instructions to respondents. The City of Conroe reserves the right to reject any and all statements and to award this bid to the proposer that offers the best value to the City, and the homeowner, taking certain evaluation factors into consideration as set forth in the corresponding bidding forms, specifications, and other information provided in the bid packet.
