Orange County, Florida, henceforth referred to as the County is accepting sealed bids for Y25-728 EMERGENCY Ocoee-Apopka Road Drainage Improvements (Y25-728) GEC Project No. 4774G This project includes stormwater retrofit along the Ocoee-Apopka Road between South Hawthorne Ave and Marden Road in northwest Orange County. Project includes drainage improvements, construction of new curb, gutter and inlets. The Estimated Cost for this project is $1,623,573.00 The County shall not be responsible for delays caused by any occurrence, including the respondent's network delays, bandwidth issues, internet outages, or technical difficulties. Question Deadline 11/15/2024 at 5:00 PM ET The question and answer module of online IS being utilized for this solicitation. Timely questions concerning this solicitation shall be submitted in accordance with the deadline for questions. Respondents are instructed not to contact the initiating division directly. No oral interpretation of the meaning of the plans, specifications, or other Contract documents shall be considered binding. The County shall be bound by information and statements only when such statements are written and executed under the authority of the Manager, Procurement Division. Answers for timely questions will be addressed electronically. Beyond questions and answers, any and all modifications, clarifications, interpretations and supplemental instructions will be in the form of a written addendum which, if issued, will be available for obtain. All addenda and questions/answers so issued shall become part of the Contract Documents and receipt shall be acknowledged as specified herein. This provision exists solely for the convenience and administrative efficiency of Orange County. No respondent or other third party gains any rights by virtue of this provision or the application thereof, nor shall any respondent or third party have any standing to sue or cause of action arising there from. Untimely questions are unable to be submitted in the question and answer module, thereafter respondents raising critical concerns must email elia.batista@ocfl.net. Critical clarifications may be made via addenda, however, untimely questions may not be considered. The Board of County Commissioners will award a Contract to the low, responsive and responsible Respondent, price and other factors considered. The County will award one Contract for this requirement. The Board of County Commissioners, in its sole discretion, reserves the right to reject any and all bids and to waive any informality concerning bid proposals whenever such rejection or waiver is in the best interest of the County. The ability of a Respondent to obtain a performance bond and a payment bond shall not be regarded as the sole test of such Respondent's competency or responsibility. Nothing contained herein shall place a duty upon the County to reject bids or award a Contract based upon anything other than its sole discretion as described herein. When more than one method of work is prescribed in the solicitation with separate pricing allowed for each method, the County will select the method determined to be in its best interests, price and other factors considered. Should the Contractor fail to substantially complete all Work under this Contract and make the project available for beneficial use on or before the date stipulated for Substantial Completion (or such later date as may result from extension of time granted by County), he shall pay and/or the County may retain from the compensation otherwise to be paid to the Contractor, as liquidated damages, the sum of $200.00 for each consecutive calendar day that terms of the Contract remain unfulfilled beyond date allowed by the Contract, which sum is agreed upon as a reasonable and proper measure of damages which County will sustain per diem by failure of Contractor to complete work within time as stipulated; it being recognized by County and Contractor that the injury to County which could result from a failure of Contractor to complete on schedule is uncertain and cannot be computed exactly. In no way shall costs for liquidated damages be construed as a penalty on the Contractor. For each consecutive calendar day that the work remains incomplete after the date established for Final Completion, the County will retain from the compensation otherwise to be paid to the Contractor the sum of $200.00. This amount is the mutually agreed upon minimum measure of damages the County will sustain by failure of the Contractor to complete all remedial work, correct deficient work, clean up the project and other miscellaneous tasks as required to complete all Work specified and this amount of liquidated damages is in addition to the liquidated damages prescribed above for failure to timely achieve Substantial Completion. Completion Requirements* If awarded this construction contract, the Respondent agrees to complete the work covered by this Contract as follows: Work shall start at the project site within fourteen (14) days of the effective date of the Notice to Proceed. Substantially complete in one hundred fifty (150) consecutive calendar days from date of Official Notice to Proceed. Final completion in one hundred eighty (180) consecutive calendar days from date of Official Notice to Proceed.
