Project Locations ADDRESS A: 1223 Shafter Avenue, Pacific Grove, CA 93950 ADDRESS B: 807 Marino Pines Road, Pacific Grove, CA 93950 Sealed bids for the rehabilitation of two (2)single-family homes("Work") under the federally-funded Housing Rehabilitation Loan Program. Bidders are required to furnish all labor, materials, tools, equipment, transportation, and utilities necessary for the completion of the Work. The scope of the Work includes both interior and some exterior rehabilitation focused on health, safety and accessibility improvements which may include foundation construction and repair, electrical repair or rewiring, plumbing repair, roof repair or replacement, heating system installation and repair, window and door replacement and repair, repair of structurally significant damaged wood, and floor coverings where it poses a hazard. Interior work will involve repairs to address deferred maintenance of kitchens, bathrooms, bedrooms, living rooms, garages, and minor upgrades to electrical and mechanical systems. Exterior work may include sewer inspections, porch and walkway repairs, concrete landings, and deck replacements. The removal and stabilization of asbestos-containing materials and lead-based paint will be conducted by Certified Abatement Contractors, as specified in the bid documents. It is sole responsibility of the bidder to see that their bid is received in proper time. Any bids received after the scheduled closing time for receipt of bids shall be rejected. Only methods of bid submission outlined above will be accepted. All bids submitted shall include a completed "Proposal", which is detailed in the Bidder Package. Each bid must be accompanied by Cash, Cashiers' Check, Certified Check or Bidder's Bond in an amount equal to not less than 10% (ten percent) of the total amount of the bid price. The Work performed under this Agreement must conform to requirements of the Project Technical Specifications and Special Provisions, which are described in the Bidder Package. 4. BID WITHDRAWAL: Any bidder may withdraw their bid, either personally or by written request at any time prior to the scheduled closing time for receipt of bids, but no bidder may withdraw their bid for a period of thirty (30) days after the opening thereof. 5. AWARD OF CONTRACT: The Agreement will be awarded to the lowest responsible bidder as defined in the City purchasing regulations whose work, in the opinion of the homeowner, the grant administrator, and the Council, will best meet the requirements of the project. It is clearly understood by all bidders that the City reserves the right to reject any and all bids and to waive any informalities or irregularities in said bids. 6. GOVERNING LAW: The Agreement shall be governed and construed according to the laws of the City Charter, the Municipal Code, the State of California, and the federal government. The City is a charter city and any agreements it enters into may be subject to the provisions of its charter, which may supersede certain provisions of the Public Contract Code and other provisions of state law. 7. LICENSE REQUIREMENT: Prime Contractor must possess a valid Class "A" license. At the time of submitting the bid, the Bidder shall be licensed as a contractor in accordance with the provisions of California Business and Professions Code Chapter 9, Division 3. However, in accordance with California Public Contract Code Section 20103.5, when federal funds are involved in local agency contracts, no bid shall be invalidated by the failure of the bidder to be licensed in California at the time of bid opening. At the time of contract award, the selected contractor shall be properly licensed in accordance with the laws of the state. 8. FEDERALLY ASSISTED PROJECT: This project is a federally assisted construction project funded in whole or in part with Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (Catalog of Federal Domestic Assistance Number 14.218). The Federal Labor Standards Provisions, including prevailing wage requirements of the Davis-Bacon and Related Acts, will be enforced. A copy of the Federal Wage Decision applicable to this project is included in the Bid Document. 9. PREVAILING RATES OF WAGES: Prevailing wage requirements apply to public works projects with a value exceeding $1,000.00. The definition of "public works" is found at California Labor Code Section 1720, et seq. The City of Pacific Grove will enforce the higher of the two applicable prevailing wage rates, federal or state. The Contractor's duty to pay State prevailing wages can be found under Labor Code Section 1770 et seq. Labor Code Sections 1775 and 1777.7 outline the penalties for failure to pay prevailing wages and to employ apprentices, including forfeitures and debarment. 10. SECTION 3 STATEMENT: This program may be subject to Section 3 requirements, which apply to housing rehabilitation, construction, and other public construction projects funded through HUD programs that exceed a total amount of $200,000. The parties involved in this contract shall adhere to the regulations outlined by HUD in 24 CFR Part 75 where applicable. 11. DEBARRED CONTRACTORS: The regulations at 2 CFR Part 180 restrict awards, subawards and contracts with certain parties that are debarred, suspended or otherwise excluded from or ineligible for participation in federal assisted program, project, or activities. Contractors that have been debarred and are listed on the federal Systems for Awards Management found at SAM.gov, will not be eligible to participate. Eligible contractors must be registered with SAM.gov and possess a Unique Entity Identifier (UEI). 12. COMPLETION OF WORK: Time is of the essence for this Project and bidders should review the Project time frame contained in the Bidder Package to insure they can meet the project guidelines concerning scheduling of Work and special actions required in the course of Work. All work shall be completed on or before September 30, 2025. 13. CONTRACTOR REGISTRATION REQUIREMENTS: A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered with the Department of Industrial Relations (DIR) and qualified to perform public work pursuant to Section 1725.5.This Project is subject to compliance monitoring and enforcement by the DIR. 14. APPRENTICESHIP PROGRAM: Attention is directed to Sections 1777.5, 1777.6 and 1777.7 of the California Labor Code and Title 8, California Administrative code, Section 200 et seq. to ensure compliance and complete understanding of the law regarding apprentices. 15. MINORITY AND WOMEN OWNED BUSINESS: Bidders will be required to document their status as a Minority Business Enterprise (MBE), a Women-owned Business Enterprise (MBE) or a non-MBE/WBE firm. The CDBG Program encourages the participation of MBE and WBE businesses to the greatest extent feasible on CDBG- funded projects in accordance with Executive Order 11625 and Executive Order 12138. Bidders that are not MBE/WBE firms will be required to make a good faith effort, and to document their efforts to include firms as part of the contract bid. 16. CONFLICT OF INTEREST: In the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict-of-interest provisions in (State LCA, 2 CFR 200.317 and 318, and 24 CFR 570.611), respectively, shall apply. No employee, officer or agent of the sub-recipient shall participate in selection, or in the award or administration of a contract supported by Federal funds if a conflict of interest, real or apparent, would be involved.
