THE PROJECT GENERALLY CONSISTS OF Selective demolition, grading, drainage, chain link fence installation, sod installation, and field preparation. Bidders and other interested parties should note that prequalification of equipment manufacturers by the Engineer prior to the bid opening may be required for this project. Equipment prequalification requirements, are described in the Contract Documents. Haywood County Schools, as Owner, reserves the right to reject any or all bid proposals and to waive any informalities. NOTE: A goal of 10% for small or minority business participation has been established for this project and those qualified firms are encouraged to participate. In addition, Prime Contractor's are required to fulfill specific criteria as noted in the Contract Documents with regard to minority participation. The bidder shall include with the bid proposal the form Identification of Minority Business Participation identifying the minority business participation it will use on the project and shall include either Affidavit A or Affidavit B as applicable. Forms and instructions are included within the Proposal Form in the bid documents. Each proposal shall be accompanied by a cash deposit or a certified check drawn on some bank or trust company, insured by the Federal Deposit Insurance Corporation, of an amount equal to not less than five percent (5%) of the proposal, or in lieu thereof a bidder may offer a bid bond of five percent (5%) of the bid executed by a surety company licensed under the laws of North Carolina to execute the contract in accordance with the bid bond. Said deposit shall be retained by the owner as liquidated damages in event of failure of the successful bidder to execute the contract within ten days after the award or to give satisfactory surety as required by law. A performance bond and a payment bond will be required for one hundred percent (100%) of the contract price. Each bidder must be appropriately licensed as a Contractor in the State of North Carolina as provided in General Statutes Chapter 87. Haywood County Schools reserves the right to award a contract to the lowest, responsive, responsible bidder. The OWNER may make such investigations as he deems necessary to determine the ability of the BIDDER to perform the WORK, and the BIDDER shall furnish to the OWNER all such information and data for this purpose as the OWNER may request. The OWNER reserves the right to reject any BID if the evidence submitted by, or investigation of, such BIDDER fails to satisfy the OWNER that such BIDDER is properly qualified to carry out the obligations of the Agreement and to complete the WORK contemplated therein. A conditional or qualified BID will not be accepted. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout. Each BIDDER is responsible for inspecting the site and for reading and being thoroughly familiar with the CONTRACT DOCUMENTS. All questions about the meaning or intent of the bidding documents are to be directed to enginer. Questions received less than three days prior to the date for opening of bids may not be answered.
