He also said that Avports previously tried to convince the Army Corps that it didn't need to have jurisdiction over the work that might affect the wetlands. "Environmental permitting is designed to be rigorous, and that's exactly how it should be," said Avports' King. "Both DEEP and the Army Corps have been thorough, professional, and constructive throughout. We've had an open, detailed dialogue to make sure every mitigation measure meets or exceeds the law's requirements. Our initial application was submitted in April and, consistent with DEEP's guidance, placed in the 12-month review track." The request for an Army Corps jurisdictional determination "was simply a procedural step based on updated federal guidance," King said. "It doesn't alter our permitting timeline or obligations. We remain on pace to complete the technical review within the expected timeframe, thanks to the diligence and expertise of the DEEP and Army Corps teams." Army Corps Team Lead Jon T. Coleman of the North Atlantic Divisions's Technical Regional Execution Center in Concord, Mass. said in a Sept. 18 letter that "based on our review of the information you furnished, a site inspection conducted on July 22, 2024, and other information available to our office, we have determined the above-referenced area contains 14.96 acre(s) of waters of the United States (U.S.) under USACE regulatory jurisdiction."
