Charlotte Water is seeking bids to provide a primary clarifier mechanism for McDowell Creek Water Resource Recovery Facility (WRRF). other inherently related activities of the Products and Services and in compliance with the specifications and terms and conditions set forth in this ITB. All Products and component parts furnished under the Contract shall be new, shall comply with the specifications and terms and conditions set forth in this ITB, and shall operate in full compliance with these Specifications and Project Manual outlined in Exhibit B. Product drawings are included in the Project Manual included within the Procurement Portal in Exhibit B. 3.3. Delivery and Storage Assembled clarifying mechanism shall be delivered to McDowell Creek Water Resource Facility (WRRF) located at 5300 Jim Kidd Road Huntersville, NC 28078. Company shall coordinate with City for exact delivery location at McDowell Creek WRRF. Delivery shall be FOB Destination. Each Bid shall be deemed a binding commitment of the Bidder to meet the delivery time stated herein unless the Bid specifically takes exception. All Products shall be delivered to the site within thirty-six (36) weeks from shop drawing approval. The City and Company recognize that time is of the essence (as indicated in Section 2.4) and that the City will suffer financial and other losses if the delivery date is not met. The parties also recognize the delays, expense, and difficulties involved in proving in legal or arbitration proceedings the actual loss suffered by the City if the delivery date is not met. Accordingly, instead of requiring any such proof, the City and Company agree that as liquidated damages for delay, Company shall pay five hundred dollars ($500) for each day that expires after the time specified for the delivery of the clarifier specified. If such delivery time is not met, the City has assessed liquidated damages for sixty (60) days, then, the City shall be entitled to terminate the Contract immediately for default and/or exercise any other remedies available by law or in equity.
