The project consists of E. 5 th Ave reconstruction, asphalt pavement, base course, curb & gutter, sidewalk, ADA ramps, storm sewer, sanitary sewer, watermain replacement and utility services. Bids will be received for a single prime Contract. Bids shall be on a lump sum and unit price basis as indicated in the Bid Form. Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 9AM to 4PM and may obtain copies of the documents from the Issuing Office. Each bid must be accompanied by a certified check or bank draft payable to the order of City of Mitchell in an amount equal to five percent (5%) of the total bid. A bid bond in an amount equal to ten percent (10%) of the total bid will be accepted in lieu of a certified check or bank draft. Surety for bid bond must be authorized to do business in the State of South Dakota. Pursuant to State Law, a copy of the bidder's sales and use tax license and a copy of the bidder's excise tax license as issued by the State of South Dakota must accompany the bid. In lieu of a copy of the license, the bidder shall submit appropriate evidence that the bidder and all affiliates have the appropriate licenses. All winning contractors and/or subcontractors must be registered in the System for Award Management (SAM) prior to beginning work on the project. Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138 (WBE). The goal for Minority-Owned Business Enterprise (MBE) on this project is one percent (1.0%) and the goal for this Women-Owned Business Enterprise (WBE) on this project is four percent (4.0%). The goals and other requirements for bidders and contractors under this regulation which concerns utilization of disadvantaged/minority business enterprises are explained in the Contract Documents. Bids may be held by the Owner for a period of no more than thirty (30) days from the date of opening for the purpose of reviewing bids, investigating qualifications of the Bidders, and completing financial arrangements prior to award of Work. The low responsive Bidder(s) will be required to certify to compliance with American Iron and Steel provision of the Consolidated Appropriations Act of 2014, as well as, shall assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produces by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities) and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project. A pre-Bid conference will not be held All questions about the meaning or intent of the Bidding Documents are to be submitted to Engineer in writing. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less than seven days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.
