Owensboro Municipal Utilities (OMU) requests proposals for the trimming and/or removal of trees interfering with OMU's lines; for cutting and/or chemically treating brush and undergrowth on OMU's right-of-way; and for disposal of the debris resulting from such work, as directed by OMU and as specified within this RFP. A formal agreement shall be executed by both parties following award and before commencement of work with terms and conditions agreeable to OMU. The term of the Agreement shall commence on March 1, 2025, and shall continue for an initial period of three (3) years until February 29, 2028 ("Initial Term"), and with OMU reserving the right to extend for two (2) successive one-year terms ("Renewal Terms") with OMU giving a ninety (90) days notice of its intent to exercise each of the one (1) year renewal terms. OMU reserves the right to determinate the Agreement by providing the vendor with at least ninety (90) days written notice indicating OMU's election to terminate the Agreement without incurring any termination fees. OMU further reserves the right to award this Agreement solely for an initial period of three (3) years without the option to extend for two (2) successive one (1) year renewal terms based on what is most advantageous for OMU following evaluation of proposals. Awarded contractor shall be fully mobilized (required workforce & equipment) and ready to start work on March 1, 2025. OMU reserves the right to modify crew size, equipment amount, size and type, and crew composition upon the needs to the utility. Prior to start of the Agreement, OMU will work with awarded contractor to establish personnel and equipment needs. OMU reserves the right to reject any or all bids and to waive irregularities.
