Issuing agency: Travis County, TX Travis County's 290 East Landfill (TCEQ MSW Permit No. 684, 9500 U.S. Hwy. 290 E., Austin, 78754, the "landfill") is operated and managed by the Travis County Transportation and Natural Resources Department (TNR). Travis County (the County) operated the landfill from 1968-1982 and is responsible for ongoing post-closure care. The landfill was closed in 1982 in compliance with municipal solid waste regulations in effect at the time. Since closure, The County has remained responsible for managing and maintaining the landfill cap and related attributes. The landfill produces significant amounts of leachate that must be managed to control surface seepage and potential discharges. The post-closure care period continues as long as significant leachate production continues. The landfill closed before RCRA Subtitle D standards came into effect. It was not constructed with a leachate collection system. In the early 1990s, the landfill was retrofitted with a TCEQ approved leachate collection system customized to the circumstances. TNR manages the leachate collection system consisting of leachate collection wells, perimeter french drains, a pneumatic collection and pumping system, and high-density polyethylene piping (HDPE) force main pipes. See item 2.2.6 Leachate Collection System Monthly Operation, Monitoring and Reporting below for the list of actions to be performed. Leachate is pumped via force main to the City of Austin's wastewater treatment system for disposal. Approximately 1300 LF of the force main is County maintained and around 2800 LF is maintained by the City. Travis County has maintained an operating agreement with the property owners since closure of the landfill. The owners of the property lease part of the site to an active business, the Austin Country Flea Market which is located on the landfill cap. A 2012 Cooperative Agreement between Travis County, Austin Country, Inc. (the Austin Country Flea Market) and Robertson Family 290 Property, LLC (the landowner at that time) provides for coordination and clarification of roles and responsibilities for ongoing operations and maintenance. See Exhibit 1. The County is currently remediating noncompliance issues related to the elimination of leachate discharges and their potential to discharge to surface waters from the leachate collection system, by abating and containing the discharge, repairing the collection system and mitigating the affected soils. Other issues being addressed include managing vegetation and erosion on the landfill cap and correcting subsidence and ponding on the landfill cap. These remediation efforts are currently underway and are in various stages of planning and implementation. Some of these compliance activities are typical of ongoing maintenance that is covered under this contract. Others may be described as unscheduled maintenance activities related to work that affects the performance of the system or involves leaks or safety risks. More significant future remediation projects beyond the scope of ongoing maintenance may be identified under this contract by monitoring and inspection and addressed by assessments, development of recommendations, and scope of work development under this contract.
