The award will be made to the lowest responsive, responsible Bidder in accordance with these Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the Bid Work to be performed for the Water Meter Installation Project - 2024 is funded by utilizing funds made available to Fresno County through the American Rescue Plan Act. Each Bid shall be made out or submitted on the form included with the Specifications and must be accompanied by a cashier's check, a certified check, or a bidder's bond, or substitute pursuant to Section 995.710 of the Code of Civil Procedure, in an amount not less than ten (10) percent of the amount of the bid, made payable to the order of the Laton Community Services District and each bid proposal shall be sealed and filed with the Engineer at or before the time provided in this Notice. The above-mentioned check, bond, or substitute shall be given as a guarantee that the bidder will enter into a contract with the District if awarded the work and will be declared forfeited if the successful bidder refuses to enter into said contract. The successful Bidder shall produce the required Performance and Payment Bonds within fifteen (15) calendar days from the award of the Contract. The successful Bidder will be required to furnish a faithful Performance Bond in an amount equal to one hundred (100) percent of the contract price and a Payment Bond in an amount equal to one hundred (100) percent of the Contract price, said bonds to be obtained from a surety company satisfactory to the District and insurance coverage in defined coverages and amounts. The Laton Community Services District hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunities to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award. Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum prevailing wage rates to be paid under the Contract, said items being contained in the Specifications. In accordance with the provisions of California Labor Code 1770, 1773, 1773.1, 1773.2, 1773.6 and 1773.7, the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, travel time and subsistence pay as provided. Apprenticeship or other training programs authorized by 3093, and similar purposes applicable to the work to be done in the County of Fresno has been determined by the DIR Director. In accordance with California Labor Code 1771.1 & 1771.4(a)(1), a Contractor or Subcontractor shall not be qualified to bid on, be listed in the Bid proposal (subject to the requirements of 4104 of the Public Contract Code), or engage in the performance of any work under this Contract, unless currently registered and qualified to perform public work pursuant to 1725.5 of the Labor Code. An unregistered Contractor may submit a Bid (as long as the Bid is authorized by 7029.1 of the Business and Professions Code or by 10164 or 210103.5 of the Public Contract Code), provided the Contractor is registered to perform public work pursuant to 1725.5 of the Labor Code at the time the Contract is awarded. Prior to award of the Bid, the Contractor or Subcontractor shall provide proof of said current registration with the DIR to perform public work to the Laton Community Services District. This Work is subject to compliance monitoring and enforcement by the DIR. In accordance with the provisions of Section 1770 of the Labor code, the Director of the Department of Industrial Relations of the State of California has determined the general prevailing rates of wages and employer payments for health and welfare, pension, vacation, travel time, and subsistence pay as provided for in Section 1773.1, apprenticeship or other training programs authorized by Section 3093, and similar purposes applicable to the work to be done. Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code 1771.4, to the Labor Commissioner. These records must be submitted on a weekly basis or as required by statute or by the DIR. The submitted Bid Proposal shall include a notarized Non-collusion Declaration. The Contractor is to comply with the Six Good Faith Efforts (GFE) listed in the specifications to ensure that DBEs have the opportunity to compete for financial assistance dollars. Failure of the apparent low bidder to perform the GFE prior to bid opening constitutes a non-responsive bid. The construction contract may then be awarded to the next low, responsive, and responsible bidder that meets the requirements, or the District may re-advertise the Project. The District reserves the right to reject all bids . All terms and conditions contained in the contract documents including the information to bidders shall become a part of the contract. No bidder may withdraw his bid for a period of sixty (60) days after the time set for the opening thereof. A time limit of 135 calendar days has been set for the completion of the work from the date of the Notice to Proceed and liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Project is not completed Prospective Bidders shall be licensed Contractors in the State of California and shall be skilled and regularly engaged in the general class or type of work called for under the Contract. In accordance with the provisions of California Public Contract Code 3300, the District has determined that the Contractor shall possess a valid Class A (General Engineering) or a Class C-34 (Pipeline) Contractor's license. Failure to possess said license at the time of award shall render the Bid non-responsive and shall act as a bar to award of the Contract to any Bidder not possessing said license
