Building Management System (BMS) Modernization for South High School Project Description: Building Management System (BMS) Modernization for South High School Project Number: RFP #05-01.30.25RFP (1) a cashier s check made payable to theDistrict; (2) a certified check made payable to the District; or (3) a bidder s bond executed by a Californiaadmitted surety as defined in Code of Civil Procedure Section 995.120, made payable to the District. Theproposal security must be in an amount not less than ONE THOUSAND DOLLARS ($1,000.00). Failure ofrespondent to provide the District with an original bid proposal security by the due date, could cause therespondent to be deemed non-responsive and the submitted proposal could be rejected.Separate Payment and Performance Bonds. Each bond in an amount equal to 100% of the total awardedcontract amount, will be required, and shall be provided to the District by the awarded contractor prior toexecution of the contract. All bonds (Bid Proposal, Performance, and Payment) must be issued by a Californiaadmitted surety as defined in California Code of Civil Procedure section 995.120.Contractor s License Classification. In accordance with the provisions of California Public Contract Code3300, the District requires that respondents possess a valid California Class C-20 Warm Air Heating,Ventilating and Air Conditioning Contractor's License for this project. Any respondent not so duly andproperly licensed shall be subject to all penalties imposed by law. No payment shall be made for work, labor,materials or services provided under the contract for the work unless and until the Registrar of Contractors hasverified to the District that the respondent awarded a contract is properly and duly licensed to perform thework. The respondent's license(s) must be active and in good standing at the time of the bid opening and must remain so throughout the term of the contract term.No Withdrawal of Bid Proposals. The District s Board reserves the right to reject any and all proposals and/or waive any irregularity in any proposal received. If the District awards a contract, the proposal security ofunsuccessful respondent(s) shall be returned within sixty (60) days from the time the award is made. Proposals shall not be withdrawn by any respondent for a period of Ninety (90) calendar days after the opening ofProposals. During this time, all respondents shall guarantee prices quoted in their respective bid proposals. Award of Contract . A Contract for the desired work, if awarded, will be by action of the District s Board of Education to the respondent that meets the qualifications and matrix established by the RFP documents.Public Works Requirements. Completion of this contract requires a Contractor to install equipment and cablingsubject to public works bidding requirements. The successful respondent and each of its subcontractors of any tier will be required to: 1) Registered with DIR prior to bid deadline; and 2) pay not less than the generalprevailing rates of per-diem wages in the locality in which the work is to be performed for each craft or type of worker needed to execute the contract ( Prevailing Wages ) .If this Project includes work that will be performed by mechanical, electrical or plumbing ( MEP ) subcontractors(contractors that hold C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 licenses), such MEP contractors must also be fully prequalified five (5) business days prior to the bid opening. The respondent isadvised that all inquiries and clarifications about the RFP documents, specifications, etc., shall be submitted to the District in writing no later than Tuesday, January 21, 2025, 4:00 PM (PST). The District will respond at its earliest possible opportunity. Verbal communication by either party with regard to this matter is invalid.
