These specifications are for ready mix concrete, quoted on a per cubic yard basis to be used by the City of Tallahassee and delivered to the site of placement. 3.1.2. General Performance This work is to be performed under the general supervision and direction of the City of Tallahassee ("CITY"). Contractor agrees to furnish at his/her own expense all labor and equipment required to complete the work, it being expressly understood that this Contract is for completed work based upon the price(s) specified according to the scope of work and the requirements and specifications detailed within this Contract. 3.1.3. Inspection and Acceptance No supplies and/or services received by the CITY pursuant to the contract shall be deemed accepted until CITY has had reasonable opportunity to inspect said supplies and/or services. All supplies and/or services which do not comply with the specifications and/or requirements or which are otherwise unacceptable or defective may be rejected. In addition, all supplies and/or services which are discovered to be defective or which do not conform to City requirements specified herein upon inspection (or at any later time if the defects contained were not reasonably ascertainable upon the initial inspection) may be rejected. The CITY reserves the right to reject shipment at the Contractor's expense for full credit or replacement and to specify a reasonable date by which replacement must be received. The CITY's right to reject any unacceptable supplies and/or services shall not exclude any other legal, equitable or contractual remedies the CITY may pursue. 3.2. SPECIFICATIONS 3.2.1. GENERAL A. All work herein specified shall be performed in accordance with the Florida Department of Transportation (FDOT) Standard Specifications for Road and Bridge Construction most recent edition at the time of bid submittal. B. The FDOT specifications are included in the bid documents by reference. C. All City of Tallahassee specifications included either with the bid documents or by reference shall supersede the FDOT specifications, and where there is a conflict between the City of Tallahassee specifications and FDOT's specifications, the City's specification shall overrule. D. All references in FDOT's specifications to the Department shall mean the City of Tallahassee. E. All references in FDOT's specifications to the Engineer shall mean the City of Tallahassee Manager - Public Works Operations or his/her designee. F. Sections of the FDOT specifications not pertaining to the production and delivery of ready mix concrete shall not be applicable to this contract. G. The following Sections of the FDOT specifications are specifically excluded: 1. 121-7, 346-3.2, 346-3.2.1, 346-3.3, 346-3.4, 346-11, 347-3.4, and 347-5.2 H. Any decision or determination pertaining to these specifications made by the Manager - Public Works Operations or his/her designee shall be final on all items. 3.2.2. ORDERING AND DELIVERY A. The City of Tallahassee will attempt to provide a minimum of 24 hours' notice to the contractor when scheduling delivery time for concrete orders. In return, the contractor shall provide concrete when requested. All delivery tickets shall refer to the item number being ordered and also reference the purchase order being used.
